At night. Not many people around. Noone to stop you. If caught, will a fine be issued?

you can take a picture on the Elevated train almost anywhere in the Bronx without fear of getting a ticket.

If you wanna take a pic inside on the train, just keep your cam hidden but close by you, shoot on the train when there are not transit cops around.

I would strongly recommend not shooting the subway station where you are almost guaranteed to get some grief if not serious trouble (depending on the way you look, your skin colour, etc...)
