I took over 300 shots today on my excursion to Centennial Olympic and Piedmont Parks in Atlanta. I took a lot of photos of this girl with the drum and the drummers in the park, and gave her Dad my card and told him I thought I got a few cute shots of her. This is, I think, my best shot of the day. But I'm not sure how much her Dad's legs hurt the shot. Your thoughts?

Well, it doesn't help the shot, but there are a lot of positives to focus on too. The child looks great, the drum is really interesting looking and adds to the photo and what needs to be in focus is.
To de-emphasize the father in the background, you can isolate the subject in PS then blur the background. What distracts me a bit is the shadow of the person's face on the father's legs. Maybe before blurring the background you could even clone that out.
Given that it's a nice pic of his kid, I don't think this person would be too critical, especially since it's an unexpected photo. |

You could probably make a duplicate layer, and cut around the girl and the drums, then add a gausian blur to everything else, then it will draw your attention to the girl, and make it look like the pic has a shallow depth of field.

What they say. Select out the girl, apply some blur and some desat to the background, clone out the face shadow, and you're home free. Photoshop is MADE for images like this, perfect shpots with distracting backgrounds.
