I did a search here to dig up an answer to this and found lots of good info, but nothing really relevant to my situation...here goes:
I have several photos I took @ the local University's football games over the last year. These photos contain, amoung other things, images of the players in uniform with the University's logo appearing. I would like to use these images in a montage to use as artwork on a website I am building. I know that I own the copyright on the images themselves. I don't know what the ramifications are to having the University's mark appearing within the images.
Can anyone help clear this up? |

Since it is a publicly-funded university, I believe you have the right to use the images in promotional pieces (like your website) as long as there is no indication that the university is endorsing or supporting any idea or product. I believe the incidental appearance of the logo in the context of a photojournalistic picture (say, promoting your excellence as a sports photographer) would be OK.
However, this is one of those "gray" areas where you may need to consult a copyright attorney. You could also write to the university describing the proposed use and ask for permission. Or just use the pics in the most legal and tasteful way you can and see if they come after you.
Again, the biggest problem is if it's presented in a way as to imply endorsement by the university. Otherwise you are likely OK.
I highly recommend visiting the US Copyright Office for downloadable manuals and forms, and Nolo Press for more legal books for people doing their own legal work.
