this begs the question should freedom of expression afford the ability to offend, merely to offend? it's one thing to make a point and offend as a by product of making your point but its another to explicit attempt to anger as the primary purpose and then hide behind freedom of expression for protection. i guess what i'm saying, should trolling be tolerated? |

It's a necessary by-product of freedom, Mike. If you constitute a sitting panel to pass judgment on which expression of opinion was "intended to anger" and which was "legitimate", you no longer have "freedom of expression" in any meaningful sense. |

It's a necessary by-product of freedom, Mike. If you constitute a sitting panel to pass judgment on which expression of opinion was "intended to anger" and which was "legitimate", you no longer have "freedom of expression" in any meaningful sense. |
im just asking the question. i guess it falls into trying to legislate common sense. |

I agree with you, but people will always seek to stand out from the crowd somehow - whether "productively" or "destructively". Everything is a pendulum. In the case of "offense/offence", it's usually a race to the bottom - who can out-offend who. While I also see a distinction between primary intent/by-product, I would not support any efforts to judge/control/regulate the former. |

Yes.
I'm not advocating being offensive. I don't think people should say or publish offensive things (this in spite of my own patchy record). But I do believe in the right to say what I think is justified, even if it is offensive. There is nothing, and I mean absolutely nothing, that you could say to me that would offend me as much as would your being denied the right to say it.
You must have the right to be offensive. You may choose to regulate yourself. They are two different concepts; not shades of gray. The first is freedom of expression; the second is freedom of choice.
