I know there was a lawsuit (Raza v. City of NY) against the NYPD who spied on Muslim groups and their activitiesâ€Â¦it got tossed and Muslim groups have their panties in a wad. |

I think the point is that not everybody is happy to have their photo taken, even in public places, or where "expectations of privacy" don't exist. So there will always be someone trying to fight the use of said image. And when that happens, it is inevitable that that or other someones will try to cook up a way to make money from the debate, often by threatening to sue. |

Exactly, but threats are one thing, finding a lawyer who thinks there's a case is another and on top of that there's convincing a judge to disregard a literal ass ton of established case law that says you don't have an expectation of privacy in public. When I get a cease and desist letter from a real lawyer, not just some bitchy email from a guy who's pissed about me infringing his imaginary rights, I'll take the threat seriously and consult with my own attorney who will tell him to go stuff it in a professional way. Simply CC'ing (or saying you CC'ed) someone who may or may not be a real attorney isn't going to cut it. |

Anyone taking a photo of someone in a public venue in the Province of Quebec might want to review the case law on that since that is NOT QUITE true.
I will look around and see if I can find the court case on this one.

Sure, the law might be different in other countries, always good to know what our frozen neighbors to the North are up to. Some of the more barbaric nations might gouge your eyes out for taking a picture or send you off to a re-education camp... Anyway, since the OP is here in the states, I figured the discussion would center around US Law.
