I have an idea for a shot but I'm not sure if it's legal in advanced the way I'm thinking of doing it.

If I were to take some bracketed shots and mege them in HDR software but have one aspect of the image move between shots and turn off the deghosting part of the software would that be considered a different scene and be illegal? Sorry for the rambling question, I'm not a great photographer and I'm an even worse writer. ; )

My understanding has always been that you can not have an element moving between frames.

That's kinda what I thought but I wanted to make sure. I have a killer idea, just not sure if I can make it happen any other way.

Yup.
And if the element DOES move, you are essentially required to use deghosting to prevent it from existing, so far as the discussions I've had in the forums have gone. However, there have been some which have fallen outside of this over the years, as well, and ghosted HDR images have not been questioned, in the past.
