the initial ruling made much more sense.

seems like a lousy decision. I'm all for "playing" with stuff, but it seems that the photographer's work is the ENTIRE BASIS for the artist's rendition. surely that is not fair use.

Totally agreed...kind of reminds me of "sampling" in music...and that's infringement
