I just read something about a city in California that is really disturbing...(it's always California...no wonder they are leaning towards Obama) San Rafael...a city of 57,000 people near San Francisco has just passed a ban on smoking in duplexes or ANY multi family home. So now the govmt can say what you can and can not do in your own home. This is WAY over stepping their boundaries. It doesn't matter whether it is local state or federal. Infact, I am sure this is against the constitution and should be taken to court. This crap has got to stop.

Benzene is one of the 200 or so toxic/carcinogenic substances found in cigarette smoke. Though personally, I suspect that about 180 of those are from the paper, and the additives used to keep it burning without bursting into open flame.

we are talking about cali....There is far too much regulation in this country as is without cali adding to it...If anything they should deregulate.

You really need to re-read the constitution. I find the ordinance intrusive and poorly thought out, but there is nothing in the constitution that limits what local government can do to protect the health of it's citizens. The constitution limits and defines the powers of the Federal government, it does not concern itself with second hand smoke laws or how local government reacts to a public heath issue.

Keep in mind the ordinance applies only to multi unit buildings that share a single HVAC unit, so anything released in one unit spreads to other units. Yes, a heavy smoker would be a bother to those neighbors sensitive to smoke, but what about those sensitive to perfume, or hairspray. Shall we limit those too? How about cooking odors? If you have a kosher neighbor won't the smoke off your pork loin make his kitchen unclean? Where do we stop?

I didnt mean it like that...I only stated that it is prob in the constitution about regulating what a law abiding citizen can do in their homes....and I admit it has been so long since I have read the constitution that I do not remember some of the amendments...etc.

Do you live in California? If not, why do the laws of that state concern you? If you disagree with the laws of California, do not live there. One of the nifty features of a federation is the disparate laws that can coexist within the union. Hate Cali laws? Live in Texas! Or New Jersey! But no need to try to change the laws, whether you like 'em or not, of states in which you do not reside. That is you trying to take control where you needn't, much like you say California is doing, yes? Or are you articulating the need for more Federal control over what states can or can't decide for their citizenry?

I do live in Texas and there are too many Californians moving here and trying to force their BS. It is mostly not working but if enough of them show up (and in other states also) we are all in trouble if they spread themselves throughout the nation.

Lets recap this thread.

The govt has too much control.
They won't let you smoke in your house(if its attached to someone else's(in California) and this is a huge problem.
California is too restrictive and California sucks.
Californians are moving out and mucking up the rest of the country with their communist, controlling laws,
Especially in Texas.

Case closed.
