		If it is just filling in texture, it may be. It all depends on:
 - Whether what was filled over (removed) was significant to the composition
 - Whether the filling process duplicated anything that was significant to the composition
 If either of the above are true, it's not legal. If neither is, it's legal.
 
 ETA: It follows exactly the same rules as manual cloning.

		Thanks! Got it. I wasn't even thinking about removing things. I was just playing with it and realized it works really well on glass glare.

		| Going from 2 to 5, I'm lost. LOL! I'll keep 2 hanging around for a while until I feel more comfortable in 5. I've moved over my topaz plug-in's. But I'm not looking forward to moving all the other stuff. |

		I LOVE CS5, have the extended version.  Can't wait to load it on my new computer when I get it.  Anyways... don't know anything with reference to your question, but thought I would say it was a pretty smooth transition for me to go from 3 to 5, there are a few new things... but I LOVE learning new things... 
 
 I'm sure you will like it!  And the content aware fill tool is awesome.
