I've seen time and again on DPC people claiming that by contacting a web host and telling them that so-n-so is illegally using a photo on their web site, the host will remove the photo, or take down so-n-so's entire site.
Is this true? I can't imagine a web host catering to Joe Schmoe, who may have some unrelated beef with the company.
How do I figure out who the host of this site is, should I choose to go that route?
I've already sent them an invoice and cease & desist last week, and had several communications back & forth.

I have had to in the past get in contact with web hosts to alert them someone was using copyrighted material on their website. The webhost did indeed take down the site as I threatened to not only sue the website creator/owner but the hosting company as well as they were the ones hosting the site.

The WHOIS shows domain info, and I'm currently emailing with someone who has the same last name as the admin contact. But does that mean the site is hosted at Tucows?

Hmm. Actually it looks like Tucows is just the registrant. The site might be hosted by Uniserve.com
I would contact both. Start with Tucows as they registered the website then move on to Uniserve as they are listed as the technical contact. |

If you're contacting the ISP, you want to send them a DMCA Takedown Notice.
Basically, the law says the ISP's aren't on the hook for infringement as long as they don't host suspect content. They'll comply with the law as fast as they can because they don't want to become a defendant in an infringement suit.

Contact 3M. It strikes me as extremely unlikely that 3M are using your photo without license, so that means this company are selling 3M products using a stolen photo, I get the feeling that will cause them a bit of a headache if 3M find out! |

I think in a circumstance like this CC'ing is your friend. If you CC the registrant while TO'ing the servers you might get a bit of action. It's like telling, but official telling :-)

Just so you have a idea, we are over a 100 million dollar company. I don't know who built this site for us but they must have used your photo without permission. If we new that, it would have been changed a long time ago. Yes 3M knows we use there logo. We are the Alberta supplier for 3M film. We are getting the FTP log in info and your picture will be removed."

He has the same last name as the domain registrant. Maybe he's a son? But yeah, pretty sad statement of the school system. :-(
