I think you've been very straighforward with them. They should realize that exclusivity can't really happen. If they are comfy with your $350 price for their desired usage, then perhaps you're good to go. If they want additional control, e.g. you agree to no additional marketing of the image to attain *some* level of exclusivity, then I think the price needs to go up significantly.

btw, for a website, they don't need hardly as much as what people put into challenge entries. maybe as small as 720px wide or as much as 1040px, and then only 72dpi. yes, they want it to look good, but no, they don't want it to kill their bandwidth.

That was quick. They got right back to me and we spoke on the phone. I sent them an invoice for $1,400+ so they have something for their budget proposal. It's not money in the bank yet, but doesn't look too bad.

We'll see what happens. I think it's a fair price. On the phone they were more interested in what uses they could have rather than pricing. So I suppose they may have some other proposed photos which will have their prices for the uses they need.

I imagine most people would be giving their photos away for free, or very little. Then it becomes a matter of how much better is my shot, and how much more do they want to use it to represent themselves versus Joe Schmoe's shot, which may be pretty good too.

I'll have to wait on their decision before I know whether to send an invoice or a cease & desist to the company that's using it without permission.

Wouldn't you stop them anyway?? Send invoice for what they have used AND cease on future :-)
