you don't need model releases for publications whose purpose is to educate and/or inform. this goes for any work that appearing in consumer or trade magazines, newspapers, or books, as well as photographic exhibits.
Originally posted by photo-on-the-net: Presuming you're in the US and as you have described it, it sounds as if you intend to publish an editorial or artistic work. Technically, your Constitutional First Amendment right to editorial and artistic expression supersedes state privacy rights (which is what model releases are for), and you do not need model releases.
This does not mean someone might not try to sue you, but if privacy alone is the issue (the mere fact that the persons did not give you permission to publish their pictures), the lawsuit will fail, as has consistently been the case.
It doesn't matter that you sell your editorial or artist work to other people for money--the Constitution allows you to profit from your editorial and artistic expression.
However, if your expression causes the subject to undue humiliation or public disgrace, that gives them another reason to sue you--your First Amendment right does not permit you to hurt people without cause.
For a couple of actual instances: A newspaper once published a photograph of a local woman exiting a state fair carnival ride taken just as a gust of wind blew her dress over her head. The woman--a married woman with children--sued the newspaper and won, claiming that the photograph humiliated and disgraced her. Now, if she had deliberately paraded around town in the nude, it would have been a different situation.
In another case, a Wall Street businessman successfully sued a newsmagazine for using his picture (taken as he exited his company) to illustrate an article about dishonest executives. He was not a subject of the article--his was merely a random "picture of a businessman" that they made the mistake of using to illustrate a story specifically about dishonest businessmen.
An outside, but connected issue, involves photographs of famous people even when you have a model release. The estate of Marilyn Monroe has been fighting photographers who have valide, signed releases for their pictures of Monroe from licensing those pictures for advertising.
They have gotten the state of California to declare those images the property of the Monroe estate even though the photographers clearly own the copyright for them and have Monroe's express permission to use them in any manner. |
hope this clarifies things for you

ditto! great book!!!
and now that you completed it (as far as sofobomo goes), i'd suggest your adding your recipes ;-) you could just add them to them end if you don't want to mess with your layout. |

Thanks Skip and sfalice!
Actually, that was my planning at first. But with only one month to go, I skipped all English recipes at day 1 (had almost 35 of them) and went to Dutch. My "food" English isn't that well, and my main problem was translating that to local available ingredients.
First challenge of adding some recipes will be Recipe (Food) IV, not expecting a great result of that, still a member of Team Suck :)
Could add (somewhere) a link to the recipes since most of them are from //www.ah.nl/recepten, just not sure how sure how your "food" Dutch is :) |

I need a project for the summer months. This weekend is the start of my July fuzzy month. Topic is Festivals in Finland. Kicking off with Tammerfest in Tampere, then we have the Pori Jazz Festival also this coming weekend, the Flower Festival then the following weekend etc, etc. So I thought I'd try a documentary approach for this one. Let's see how it goes. Pori will be interesting as it attracts some big bands (not always anything to do with Jazz mind you!) |
I'm looking forward to your finished work - sounds like a great subject, with lots of potential for great photos! |
Hmm, this book maybe a bit of a bust. Didn't get to see the Flower Fest properly, nor Tammerfest. Sigh. Oh well, let's see what I have got. It maybe a very short book :) |

I really want to do this but it won't let me register. It says I've mistyped the anti-bot code. I've tried it at least 10 times now and no, I haven't mistyped it. Weird. |

I tried to set up a new account and it worked fine (testing to see if there was a date restriction due to the fuzzy month period having started already). So, it is a bit weird, yes. I'm on IE8 (from work). Hopefully you can try again?

Thanks a lot for the encouragement but I've now tried on Firefox and IE8, with no luck. I'll try later. Funnily enough I cannot get on the forum to ask what's wrong. It would appear I can still register, but there's a bit of a glitch. |

i know what you mean and feel your pain. i had some other ideas that just aren't panning out. i *may* have time to pull one of them together, but august is already filling up pretty quickly.
good luck!

It's likely user error. ;) I'll try again from home later. My work machine does suffer quite a few glitches, so I will persist. |

Hey, so I have some questions for those who have done this SoFoBoMo thing before.
I don't think the challenge for me is going to be getting 35 images together (maybe picking "which" 35!), but rather getting the PDF book laid out. I need to figure which app I am going to use to do this and then get up to speed on using that app effectively.
I use Macs and have the full CS5 Designer Suite of apps, so I could use InDesign maybe. I also have Word for Mac 2011. And going simpler I have Apple Pages too. I want to keep the process somewhat simple making me lean toward using the Pages app. But I also don't want to limit myself as far as flexibility goes either.
I expect all I will ever do with the book is produce it in screen readable size. But just in case I would want to print the book I would need a much higher resolution copy. To have myself covered for both outputs, I am wondering if one of the above apps would allow me to produce a high resolution book for print and then globally downsize all the contained images for a screen readable book? This is why I worry about going with a very simple app- if it lacks a feature I might need.
Anyone care to share some advise on which app I should use for creating my book?
Thanks! -Brent |

I used Blurb (blurb.com) BookSmart for someone's book and found it very easy to use and learn. |

Brent, do you have Aperture? the built in book functionality in Aperture works best from what I have found, especially as you can print straight to a reduced size pdf and retain the original high res file for printing by Apple, or even save each page as a high res jpeg and import to Blurb for printing. This is my third year with SOFOBOMO, and I've done it with Aperture each time. iPhoto would work too, but you don't have the flexibility with the book layout. In Aperture they are fully customisable.
Otherwise, as you have InDesign already, I suggest you use that. You could download one of Blurb's Indesign templates which are available on the website. Blurb's pdf to book option is quite handy from what I can tell (I don't have InDesign, so have not used this). Blurb PDF to Book InDesign Plugin
Blurb Booksmart is not much use for this project as you cannot create a pdf file without having their watermark "this is for proofing only" across each page.
Drop me a pm if you want more info

that's what i use. i find InDesign preferable for a number of reasons:
* complete flexibility and control over layout
* seamless integration with other adobe publishing tools
* ability to publish the same pdf any numerous resolutions
* ability to create a blurb-ready pdf to their specifications
as mentioned before, learning InDesign was one of the main benefits i've gotten from participating in SoFoBoMo.
good luck! |

Margaret, Sarah and Skip, thank you all :)
It sounds like InDesign will be the way to go for me. Being able to publish in different resolutions is a big plus, and I need to learn that application better for designing brochures for my business.
I'm using Lightroom in my workflow rather than aperture, but I already found a post where some helpful person describes how to make LR and ID work together- cool! I'm also fortunate to still be on good terms with an ex-girlfriend who has done several books using ID, and she offered to give me tips if I need them.
Thanks again- looking forward to doing this project, and no voting trolls in the mix! Lol!

This is exceptional work, Daisydavid! Just exceptional. The layout, the font, and of course the excellent content. Good job.

Amazing, Paul. I haven't been to the Marin Fair in a number of years, but felt as if I had attended this one.
Your pictures and narrative were comprehensive and fun to look at and read.
It's quite a puzzle to put together one of these books, and it's especially interesting to see how each of us has gone about doing it.
PS: congratulations on your acceptances and Ribbon.
