So this girl follows the crowd and does'nt follow the warning signs. Then blames others for her unfortunate situation. "âExperienced divers and swimming onlyâ. No one informed me to consider this sign and even had I noticed it, well first of all I was jumping not diving and yes of course I could swim."

It sounds like she's blaming Rick's Cafe for the fact she was injured while diving off a nearby cliff.
I wonder is the cliff even part of Rick's cafe? - It certainly doesn't sound like that company own or are in any way responsible for it. In fact, they'd be mad to claim any sort of ownership over the cliff or the diving activities from a public liability perspective, especially if locals and random drunk tourists are diving off it all day. That's asking for trouble. |

I'm not sure they own the cliff. But why would you jump/ dive from that high if your not an experienced diver? |

It may be "mad", but try googling "Rick's Cafe Negril Jamaica" in Google Images and you'll see that the property literally surrounds the cliff, it's all sort of integral to the scene. Check out the mobs there, all drinking booze, all cheering on the jumpers...

i'm not a lawyer, but even i could poke so many holes in her "claims" it is not funny. it just reads like an episode of "i really want you on my side, so i'm going to tell you just what you need to feel sorry for me."
like we say around here, "if you are going to be stupid, you better be tough."
and then there's the whole *personal* responsibility that so many people seem to lack.
had the cafe advertised "come jump with us" and solicited her business specifically to jump, i might feel a bit more sorry for her.
Jamaica Tours Limited needs to implement a better warning slogan than âdon't drink and diveâ. Tourists should be warned of possible consequences before they step off the bus. Jamaica Tours Limited should send out a memo to all of their sales people asking them to describe to potential clients the dangers of some of the excursions they offer.
WE ARE ALL RESPONSIBLE FOR THE LIVES AND SAFETY OF ALL YOUR CLIENTS. I CHOSE TO BE RESPONSIBLE IN WARNING FUTURE VICTIMS.
I just asked my 6 and 9 year old if it was safe to jump off of a cliff. They both said no. I asked why, and what could happen, and my 9 yo said you could break your neck and my 6 year old said you could bust your head open.

An old Sufi saying tells us "There are no signs in the desert telling us not to eat the stones".
Before lawyers one was expected to be able to assess dangers and balance them against your skill. If you were wrong you might die, but those are the choices that an adult makes. Now we have people who feel they ought to be protected against their own lack of judgment, their own lack of skill and from their choice not to read the really, really big signs that warn them against the dangers and risks they are about to undertake.
I have jumped off those rocks, and they looked pretty damned dangerous to me, it is about a thirty foot drop over rocks into a mildly churning sea. Given the changing surface of the ocean, hitting the water is much more dangerous that hitting a lake or pool, and it is possible to land on a sea turtle or a dolphin and really do yourself harm, even if you land properly. If you have never jumped from that height into a pool, then you would be a fool to try it there.
Risky sports are risky. If watching someone dive off the cliffs or bungee jump looks exciting, it is because it has a risk to the participants, but some folks will risk death for the thrill. Winston Churchill said âThere's nothing quite as exhilarating as being shot at and missed.â Wilderness skiing, skydiving, free diving, bungee jumping, they are all thrilling because you just might end up in a hospital, either in a bed or on a slab. And if you get hurt because you thought it was going to be easy for you to do, you are the only one to blame. |

33 feet isn't high if your an experienced diver lol. But land wrong and your gonig to do some damage. |
