Makes no difference, you don't acquire the correct usage rights when you buy the CD or MP3 to use it for this purpose even if your not selling it... and the record companies have taken a hard line on students and whatnot even without them making a profit, so anyone is potentially in their firing line (as stupid as that is)... and besides I doubt - say - U2 needs the exposure :-) [seems to be all the big names that get used like this]. There really are a lot of artists out there with some CC/RF music that would welcome any exposure.....

Yeah, I was under the impression that if you paid for the music and didn't copy it for re-sale, then it was OK to use a song to back up a family slide show. That's probably just an assumption on my part. If it is indeed a violation of rights, I really doubt it would be enforced, or even frowned upon by the artist, in the OP's situation.

So robs- have you never downloaded a song off the net, burned a copy of your friends CD, recorded TV show or movie playing on TV back when VCR's were around, uploaded some songs to your MP3 or Ipod? cause if you did then this would be doing the same thing.. come to think of it - don't you think that if it were that wrong to use for non-profit that they wouldn't sell MP3's or not have the app on Ipods? I'm ust saying.. something to ponder..

This recent article might have some relevance. Alternatively, you can grab any recent thread about a web-site using someones image to see the general feeling around here on what is an identical scenario.

There are lots of CC/RF licensed stuff out there as well as some sites that will get you something more custom for some more $.

Yes but only Free/CC/RF dist songs put up by the artists or purchased off legal sites.

Yes but living in Oz at the time of VCR's this was fair use for non public replay... but anyway I am talking about music usage on your products not television time shifting.

People can justify all sorts of things and that's for each to determine but I am just saying what the law says - you just don't get the correct license when you buy MP3's or CD's oe whatever in 99.9% of cases to embed in other products. Is it illegal because your not caught... people will have different positions on that age old question :-) I think the law's as written are pathetic and that should be corrected but just doing this gives the bad guys (IMO) ammunition to continue with pathetic rules.
