This thread has been so quiet! I have an entry waiting for validation in 9. I've been trying to figure out why anyone would question it. It's quite vanilla.

Anyway. I'm not sure if I mentioned this, I recently moved (which I know I mentioned). When I signed my lease my landlord was aware I had a dog. He was fine with it. Now, my landlord is being sued due to another tenant's pet (I'm not sure how many properties he owns) and his lawyer told him all of his tenants have to remove all pets from his properties because of his insurance. So, he'd let me out of the lease or I can find my dog another home. The problem is, I can't afford to move again. I feel like I've been blindsided. My dog is a mixed breed and has some pit bull in him (and it shows in his face). Even though he is the sweetest dog in the world, he would be put down if I put him in a shelter because everyone is so afraid of pits. Anyway, I've put ads on craigslist and met and rejected one family. The anxiety of meeting them was terrible. And they were lovely people, just not right for my dog. Now I'm meeting someone else Saturday and the anxiety is cranking up again. I really do need to find him the right home and yet I really don't want him to go. It feels like I'm giving a child up for adoption.

That's terrible, Kelli, I'm sorry to hear you are going through that. Have you tried any pit bull rescues in your area? Even though he's a mix, they might still help out, given how they know how hard it is to re-home pits. I know someone in your area that may be able to help - I'll PM you about it.

the pit bull rescue is a tremendous idea, and I think a wonderful way for him to find a new home. Because it's only the people who understand and want pit bulls that will go to the rescue. So many people are misinformed about these wonderful dogs that they might be hesitant at a regular shelter. The breed rescue places were started by people who really love the breed and want to help.

I feel so bad for you--what an awful position to be in! It's so unfair!!

You might want to talk to a lawyer before you give up your dog. If you have a written lease and he knew about the dog at the time he signed it, I would be surprised if he can force you to give up the dog or move before the end of the lease term. Might be some resources here to check out. Sometimes a lawyer will meet with you for free to let you know what they can do (and fill you in on your legal rights), or may even take the case on a contingent or pro bono basis if what the landlord is doing clearly violates the lease or local laws.

ooh!! I like that! (but he could probably raise the rent then... usually they have a clause to be able to do nasty things like that)

this is kind of strange. Why would anyone sue the landlord? Sure, he has more money, but it's not his dog. the tenants renter's insurance should cover it. and if they didn't have renter's insurance, I still don't understand how the landlord is liable...

But if he is liable, then it's almost understandable. My friend's son was bitten by a relatives dog. Even my friend said it was a sweet, family dog and the kid probably gotten between it and food or something. Anyway, if the relative turned the medical bills into the insurance company, she found out the insurance company would drop them and they would not be able to get homeowners insurance through other companies if they still had the dog.

Karen actually sent me an email along those lines. But here's what I emailed her back...

Actually, "no pets" is in the lease, but he said disregard it because he allows them at his discretion. He had to meet the dog and all that first. And he did and it was fine. I talked to my next door neighbor who's been here 25 years and she said the previous tenants have always had dogs (which is why I believed him and didn't worry about what the lease said). The lease was just a standard one he got off the internet. Which is why he said if I wanted out of the lease it wouldn't be a problem. But because it's there, I'm sure I couldn't make him pay my moving expenses. It took me 4 months to find this place. Rentals are hard to come by right now in Camden County (prices are out of reach too). I'm paying $1200/month here and it's the cheapest I could find. The thing is, though I love my dog, I have to make sure my family keeps a roof over their heads first. I'm just so frustrated.

This is my own stupidity for not have it stricken from the lease and initialed by him. I just believed him. And though I don't know the full story about him being sued, I do know that it actually involved a snake and not a dog. I'm seriously thinking of moving south after this school year. Maybe Georgia or Florida. I've been checking rentals in those areas and they are much more affordable.

A lease is a contract, and should state explicitly what's allowed and what's not. Usually, the rent can't be raised during the term of the lease -- that's why people get them instead of living under a month-to-month rental agreement.

If the lease does not prohibit the dog, I don't think they can make you move or give it up.

That lease clause will complicate issues, but its not a slam dunk that you would lose. There are doctrines like waiver and estoppel that could prevent him from enforcing those clauses, since you relied on his representations that those terms would not be enforced, and he in fact let you move in knowing you had the dog. If you wanted to move, you might be able to force him to pay increased rent you would have to pay if you moved + moving expenses, but probably only for the term of the lease.

Maybe its not worth the hassle and there are no guarantees you could win, but I just hate seeing people taken advantage of, and here I think you might be.

Given what appears to be reasonable issues with lease agreements, I wonder if the landlord's story about the insurance company requiring him to remove all pets from his properties is true - can insurance companies do that, and would they, given the obvious problems this would cause with existing lease agreements? Maybe he's stringing you a line so you'll be more sympathetic and agreeable?

- just reread Kelli's initial explanation - apparently it's the landlord's lawyer that advised him to remove all pets, for insurance reasons...

- this is looking like perhaps he would just prefer not to deal with pets so as to avoid further lawsuit issues, not that anyone is really putting the screws to him about it - maybe you should reconsider acceding to his request? As Dennis said, you may be taken advantage of here...
