Good to hear. Did you see how much she is selling the 8x12s for? And when you say she is selling the canvas for about $550 and you make $125, who pays for the canvas to be printed? |

Under most circumstances, Galleries take from 40-60 percent. This is the standard fee. This is done, because the gallery may do the PR, pay for the rental of the space, pay for the opening party and hire a PR person to launch the exhibition. So NO you are not getting ripped off if the gallery is doing all of the above.

Here is LUMAS Galleries. They have 15 galleries around the world and they take a lot more than 40 percent.

So is it out of line for me to ask why practically this whole thread has been censored? It seemed to offer some good information...why all the redacting? |

Because someone was worried that someone else(the gallery) might read this thread and see the conversation that was taking place that at times made him look like he was worried about being ripped off by the gallery.

I could be wrong, but the revised US copyright laws automatically give copyright protection to every work at creation, without registration, and without a copyright notice of any kind. You do, however, want to establish "proof" of the date/time of creation and that you were the creator (and thus, copyright holder).
Generally, copyrights are only enforcible if you enforce them. If you knowingly allow someone to distribute your work without objection, you've basically put it into the public domain.
It does get kind-of weird when you take a photo of a copyrighted work (for example, the Longaberger Basket building is copyrighted - yeah, that's weird too). You own the copyright of the photo, but it is considered a "derived work", and you must get approval from the copyright holder of the photographed work(s) in order to distribute the photo. Note I said "distribute" and not "publish". You can't even give away copies of your own photo.
News photos are generally exempt from most restrictions on containing copyrighted work(s).

Your rights to collect certain kinds of damages and attorney's fees are limited without timely registration. The financial stakes in a copyright infringement case are significantly different in situations of registered works compared to those of non-registered works. |
