I usually don't post in rant but I have something I need to vent about!!!

Being a photographer and a designer gives me a different outlook on stock photography than other designers have.

Do you know that there are many MANY designers out there who do not bother to read the TOU on the microstock sites?

They think that if they pay $.25 for an image, they can use it in a mass marketing campaign reproducing it millions of times for the covers of books, etc...

I have tried and tried to tell them that they CANNOT do that!!! They are STEALING. They purchase a license for PERSONAL or ARTISTIC use when they pay $.25 or $1.00 for an image. The price for an image goes up considerably when using it for mass publishing. They are going to get their clients SUED!

So, anyway, for all you microstock photographers, if you THINK you see your image on something you see in a bookstore or on a shelf... check it! Because these people just DO NOT listen and it may very well be yours.

I am ready to choke somebody! Anyone have any soothing words or suggestions on how to get the point across to these folks??? I have tried. I even went as far as copying some of a microstock website's TOS and pasting it for them to read. Still, they tell me I am CRAZY.

I am not crazy... am I???? o.O

Perhaps a cattle prod would help. We are working on getting this technology working via javascript for use on low voters who don't leave explanatory comments. I am sure we could modify it for use on stock sites.

I'd suggest sending your complaint and all available relevant information to whatever stock agency/agencies from which you think the image was downloaded -- I bet the agencies will be more than willing to go after (former) customers who violate their TOU -- after all, the site's losing more income than you are! (And probably has an attorney on retainer for just this kind of thing.)

I'd say DO NOT try to fight this out with the designer/publisher yourself -- as you indicate, the contract they've broken is with the stock agency; it's not exactly a violation of your copyright; though if damages are recovered, I'd think you'd at least be entitled to the appropriate royalty.

Also remember, that at some sites, designers are ALLOWED to do these kinds of things under what Shutterstock calls an Extended License -- I had a couple of those a month or two ago, and was paid $28.00 rather than the usual $0.33 ... :-)

Good idea! I may just do that...

Glad to know I'm not crazy. I don't want money. I just want these folks to stop cheating people.
