From PhotoAttorney blog:
"WiebeTech is sponsoring a photo contest and the winners get a RTX400-QR or a ToughTech data storage drive. While the prizes are great, the rules are even better! Check out the simple and up-front rules (although copyright is mispelled) that give a license of your photos "to publish your entry on the web at a reasonable resolution for screen display in relation to the contest."

Has nothing to do with the rules on this site. Perhaps I could have titled it better. It was posted in light of the few threads recently about photo contests where people were pointing out the terms of submitting and that they basically gave away all rights to their submissions if they entered.

What caught my attention were these rules:
Terms and conditions

By submitting a photo you agree that the photo is yours, that you own all copywrites, and that this is your original work. You also understand that it will be published on the internet as your work, and under your copywrite. WiebeTech will not claim ownership of any submission or use it in a non-contest related way. WiebeTech desires to publish your entry on the web at a reasonable resolution for screen display in relation to the contest. You agree that submissions will be reviewed before being accepted for the contest. If the photo is offensive, artificially enhanced, a studio image, animation/artwork, or of poor image quality, it may be disqualified. You may enter this contest a maximum of five (5) times.


As compared to this contest which is posted further down on the same PhotoAttorney blog:

"Snapfish and Travelocity are sponsoring a photo contest of favorite winter "getaways." The winner gets a trip to sunny Orlando, Florida.

But the Terms and Condition (provided by a link posted underneath the "Judging and Rules" paragraph) of the contest provide that:

[B]y submitting an Entry, the Entrant grants permission for Sponsor and Sponsor's Affiliates to publish, post, display, and otherwise use the Photo in any form, in any manner, and in any media deemed appropriate by Sponsor or the Sponsor Affiliate, without compensation of any kind to Entrant.

Further, the "'Sponsor's Affiliates' includes all entities associated with the Sponsor (the Hewlett-Packard Company) for purposes of this Contest, such as subsidiaries, affiliated companies, advertising agencies, promotional agencies, and judges."

The Terms and Conditions admit that the total approximate retail value of all of the prizes to be awarded in the contest is $4,600. So HP, and its "affiliated companies, advertising and promotional agencies, and judges (?) get the unlimited use of all submitted photos for less than $5000, compared to one winner getting airfare/hotel for Orlando and 40 runner-ups getting a custom cover photo book or a collage poster.

Seems like a photo contest to "getaway" from!"

Very interesting. Do you think this will allow them to post your work without referencing you?

what is artificially enhanced?

and could you find anywhere where it said they wouldn't sell your phone number? I looked and didn't see it, but may not have been looking in the right place.

So no Photoshop (artificially enhanced), and no studio images?? So to you a contest with decent rules is a snapshot contest?

I don't see that part as being significantly different than our own TOS. Are we not decent, or are you just pointing out some other contest which also has decent rules? The title of the thread gives the impression that somehow those rules are more "decent" than ours ...

I thought he was just bringing into question the legitimacy of a site that doesn't take the time to spell check their terms of agreement.

I dunno if I'd believe 'em. Look at the recent entries and tell me that there's even one that isn't artificially enhanced. So if they approve those for entry, can we believe anything they say? :)

No they didn't misspell it, they just entered the wrong term completely. Copywriting is a different job. It is the job of writing copy for advertising; print, radio, television, etc. They are the masters of how the words get written/said.

That said.... it's nice to see a contest that isn't a rights grab.

I wasn't scolding you.... I mentioned it with the intention of letting people know that it is a real term, just wrongly used. Not that many know what copywriting is, that's all. Hackles back down please (if they were up in the first place anyway, just can't judge tone here!) :-)

I got a call today from a nice lady at Wiebetech. She said she was calling to congratulate me on winning the grand prize in their contest. I had forgotten that I uploaded an image months ago just for grins. Nice folks and they'll definitely be my choice for storage arrays from here on out.

Dear spiritualspatula,

Not really. They called me back about an hour later to ask what platform I use so they could format the drives correctly for me. Based upon that, I'd say it should arrive sometime next week. I don't know where they are located, but shipping time to Texas from most anywhere is five days at most. I have 50 TB of external storage (mostly LaCie Big 4 Cubes) running 24/7 and it's about 80% full. I think I'll dedicate this to HD video and see how it works. Nice surprise anyway.

Holy crap that's a lot of storage. I guess if you're doing HD video it makes sense that you'd need that insane an amount though.

That is all still images. I've just started working in Final Cut very recently. I shoot four Canon bodies, three 1Ds MKIII's and a 1D MkIII and fortunately I'm booked all over the world fairly solidly, so it takes a lot of gigs to keep all that backed up and live. Take a look at my site //www.jimwilsonphotography.com I think you'll enjoy it. My work spans a myriad of subjects which is fun. One day I'll be shooting the Thunderbirds air to air, and two days later I'll be on the opposite coast shooting commercial architecture. I thrive on the variety.

That's a pretty slick site. I take it that's Rainier poking through the clouds in that shot of the mountain top with clouds?
If you don't mind my asking, where was the photo of the plains with the windmill taken? East Washington or elsewhere?

Oh, and to post something actually RELEVANT to this thread.....
There's a newspaper here that I've submitted some stuff to for the Outdoors section, and they've published some. Well, they recently started a contest. Most of the rules are pretty standard, but check this out

COPYRIGHT. By entering the Contest, each contestant grants to Sponsor an exclusive, royalty-free and irrevocable right and license to publish, print, edit or otherwise use the submitted entry, in whole or in part, for any purpose and in any manner or media (including, without limitation, the Internet) throughout the world in perpetuity, and to license others to do so, all without limitation or further compensation. Each contestant further agrees that if his/her entry is selected by Sponsor as the winning entry, he/she will sign any additional license or release that Sponsors may require.
