Could some one help? Maybe this has been asked before and I am sorry.

Is it legal to use the photo filter in PS? I do not want to break the rules or anything.

Which flter in particular? Some are legal, some are not. Per the rules, gaussian blur and noise are the only two efects filters permitted under the "restricted editing" rules.
Noise reduction and "dust/scratches" type filters are permitted, as well as other filters that are intended to "...preserve the integrity of the image and/or reduce the effects of noise, scratches, etc."

It is a filter under adjustments to photo. It is like adding a warming filter or cooling filter to the whole picture. It is done to the whole picture but not sure if ok.

Yes, Im almost 100% certain this is OK. You can also get the same effect as pretty much any of these filters with curves adjustment, which is also completely legal.
