I figured this would be a good place because you guys seem to know a lot about art. Alright so Theirs this guy names soulcliche that I am a aquatence (mispelled) with.. Well I was going to buy a domain and hosting and he was going to make a template and we where going to start up a big web development website to sell templates on. Well I bought hosting and a domain but he has yet to even finish designing the template.
Well heres my case, He has been sending me resized previews (800x800 rather than 1000x1000) So want I wanted to do since he totally stopped working on the project is get his preview and totally remake it but with the same colors and the placement of content..
I wouldn't be reverse engineering or copying and pasting because I am totally making everything myself just using his idea..
I was just wondering if this is legal.. If I should do this or not, Thanks. |

What was your agreement supposed to be like? If he was working for you -- supposed to be paid for providing a product -- then you have a case for the items being "works for hire" where you own the copyrights.
If you were supposed to be partners, co-owners, or anything else, it's more complicated. |

We where suppose to be parteners. He has better taste in art than I do, But I have more money. So I was going to pay the bills and he was going to make a template.
Any ideas please?
And I'm not really looking for a "you snooze you lose" saying, lol.

Heres images to display whats going on.. And I don't know why his turned out so small, File size was probably to big.
But as you can see I totally remade everything, His was 800x800 and mine is 1000x1000, They look very similar but I just copyd the idea.

To me it looks like only the size is different. What was actually changed? |

You join this site today, immediately post looking for legal advice on a situation that you did not detail very clearly, and then insult a long-standing member that asks for clarification? Wow.
If you did NOTHING MORE than resize his work and insert different clipart, you are ripping him off. Period. However, it doesn't really look like there is much original there to rip off anyway.

I wasn't insulting him and if I was I believe this is the ranting forum.. And I didn't just "resize" I make my own boxes and rounded-edge boxes that look similar and I used the same colors. So no I did not copy his work.. I copied his idea which again.. Learn to read, And yes I'm insulting you now.. As I said in my first post... "I wouldn't be reverse engineering or copying and pasting because I am totally making everything myself just using his idea.." I created everything myself I only used his idea and colors.. Colors are not plagerizable, Just to make that clear for you.
And I wasn't looking for this to be an arguement.. But if that's what you intend it to be, Then bring it on because I'm ready.. |

Then please find another forum to do it on. We do not throw insults at each other, and we expect and demand civility.
You presented a situation, others asked for clarification. If you want to continue to seek assistance, fine. If you simply want to argue with what is being said to you, not fine. |

If you go in your garage and hammer out a Mustang and then try to sell it, you can bet that you will get a call from the Ford lawyers. Yes, you hammered out and built the car, but it was their intellect, engineers, and design people that gave you the idea.

Okay kawesttex so this is 100% illegal? Damn I have another template that I made myself but it is like 100% impossible for me to code because I know just about nothing for coding.. Dreamweaver does the majority of things for me..

That's my template and yeah I would pay for someone to code it but unfortunetelly I'm only 13 and theirs no jobs available for me, lol.
