Hey all,
I previously discussed my issue about my 50mm 1.4 that I had ordered on POTN (about 2 months ago). This is the original thread. Long story short, my 50mm came with non working auto focus, so I immediately pm'ed the guy and asked him where we needed to go from there, he told me that he would give me a full refund as soon as he knew that I had sent him the same exact lens. Through multiple events and a bunch of excuses and a months time, he finally told me that he had gotten the lens (relief on my part). I could finally get my refund. Well, not really, he told me that he hadn't gotten a chance to look it over, then he didn't have the money, then he sold the lens and had the money coming in via e-check and as soon as that cleared i would get my refund. That was almost two weeks ago. Last week I pm'ed him and said very nicely "has the e-check cleared", still no response, sent him one today, "get back to me as soon as you read this and tell me the progress on the e-check".
Step back a few weeks, I had filed a dispute with paypal just to make sure I was covered, when I didn't get the money I told him that I was going to raise it to a claim, after 3 weeks of having the dispute open with no progress. Woo hoo I was covered (or so I thought), turns out paypal doesn't cover situations that don't relate to shipping/receiving issues. Turns out I shouldve filed it without taking this dudes word.
My question I pose to you guys, where do I go from here?

next time use a credit card , I don't think you have a chance for a refund , good luck

POTN will not arbitrate or guarantee any user or transaction. So no help there. As you say, Paypal will not arbitrate a delivered item. If the seller is in the USA, then offer to take this situation to the police and file a complaint for wire fraud. If he has any sense of feelings, this might well wake him up. If I think of anything else, I will update. Sorry for your agony. Better to buy new from B&H or Adorama - and avoid reconditioned or refurbished lenses. They are not worth the hassle. Even if one is feeling poor, the hassle simply ain't worth it. |

Yeah it was in Canada was the thing, so no luck there.

The worst part, is kicking ones self. I guess we all do something like this at one time or another. Usually, these things happen when we're trying to save a few bucks. Water under the bridge... These days I avoid eBay etc. I do use Craigslist.com because I can go see the item I am buying and test it. If need be, I can take a friend along as well. Not sure if that venue is good for you or not. |

Yeah, I just went about using paypal wrong, I should have not trusted the guy in the first place, and just used paypal to get my refund, but the weird thing is that if he is scamming me, why does he keep making excuses, he should just ignore me if he is gonna scam me.

I just found out something crazy. I did a search for the dude who sold it to me on POTN via his username. Turns out he bought it from someone on Fred Miranda a few days before selling it to me. Turns out he knew it was defective before he bought it considering the original post said that the 50mm lens was defective with the AF, so he was selling it for cheap. Now the dude is up $280 and he has the lens to scam another person.
Life goes on though, I'll probably pursue it some more, but I'll survive.

That's a hard lesson to learn Ryan, hope you get something out of it. Life can be sh*t at times :-(

tell him in an email you either get the money in 24h or you are going to alert the local police, chances are he has done this before and you have some pretty good evidence which the police may take seriously in what ever city he is in. So either you get your money or the police will most likely harass him and you may get the money...

Sorry to hear about the problem Ryan. Did the item get shipped through the USPS? If so you may very well have a case of mail fraud on your hands. He sent you a known broke lens, representing it as a functional lens(you did print both posts right?) I believe that using the postal service to defraud someone, then also agreeing to reimburse you when you returned the lens(USPS?) that is likely a second case as well.
Check with the post office you recieved it through and see what they say. I'd also contact the local PD where he is from. You have his shipping address still right?

Hey thanks for the advice, I had my dad pm him from mine that we have been communicating on. We gave him until the weekend to refund the money or we would present all of the evidence to the barrie police (where he lives). In the PM we linked to the Fred Miranda thread where we found out that he bought it broken. Well I hadn't heard from him in three weeks. My dad sent the pm at about 7 last night, and midnight last night I got an email from him saying that he had payed me a partial payment (about half of what he owes me), and that he did that "before" he read the email from my dad. So he hadn't responded in 3 weeks and coincidentally within 5 hours he responds to a email that is threatening to his lifestyle (a.k.a. staying unarrested). He claims that he will get us the refund within the month and that he doesn't want to hear from my dad again. He also claims that he had the lens repaired before he shipped it to me, so that the fredmiranda thing was invalid. Oh well, we'll get the rest of the money out of him somehow. Thanks for the advice everyone, and Matt, if this doesn't work out, I'll try the shipping fraud deal, because he used Canada Post to ship it to me and I used USPS to ship it to him. So we'll see how it works out.

Good going, Ryan. I've been burned before by ebay sellers; once I was foolish enough to leave someone positive feedback because the guy said "I'll send you a partial refund only if you leave positive feedback first." Of course the minute I clicked that button, I ceased to exist for him. |
