If something in the forground is distracting, instead of cloning it out, is it legal to blurr it out?

Depends how significant a part of the original composition it is, and depends on how much you obliterate it with the blur. It's a very subjective call. Send a ticket with your image before-and-after to SC and ask them what they think.
