I just wanted to say that I am currently making a brochure for my mother who owns her own business and I have taken all of my own photos for multiple reasons...

1) I don't want to have photos from her brochure that can be found in other brochures of other companies that are similar to hers because that would be way too tacky...

2) I know I have complete rights to a photo that I have taken and I have gotten all of the correct permissions from all of the people in photo so no problems with lawsuits in the future...

3) I can have high quality photos taken exactly in the pose and manner that I want...

I think that you did the right thing and I am glad that you were able to get paid!!!

Uh... have you read any of the rest of the thread? I did contact them... I did not sue them... I asked them for a reasonable payment after finding that they had used my shot without authorization... they agreed, and I received a check in the mail today.

I am not saying that you should bring a lawsuit per se, but I think that if they ignore your complaint about using a photo of yours without asking then you should have a problem with it because that photo is your personal property!!! or more professionally, intellectual property of yours.

You should definitely be paid for their use of your photo and I think that you should ask for more than you would have had they asked you in advance because everyone knows that using something that is not your own is illegal and a business has no right to do it.

Making nice does work better sometimes and you did not have to pay 40% lawyers commission either. Glad to hear of the good ending.

It's essential that you protect your rights to your photos or this can be used as a defense to stealing your images in the future. Nice work! I had a similar situation happen to me. I work with too many lawyers....They paid.. Not too much but enough to show I protected my rights.
