How about all those mall guys that do "portraits" they must be infringing left and right with the Bruce Sringsteen pictures and the like;
It seems like this Afremov guy is one of those type "srtists" that has leaped from the mall to teh world wide web.

I'm an avid Ebay person and I just dropped him an "ask seller a question" asking him if he was aware that two of his images - the deer and the Brooklyn Bridge were exact copies of photographs on DPChallenge.com. I did that before reading the entire thread. I hope that doesn't mess anything up, but I love to make people like that squirm. It's so blatant. GOD that ticks me off!!! |

What now? I am thinking forget the money or legal, and basically launch a campaign to ruin his name?

Since he's using E-bay to sell his work, would it be possible to get them involved to pull him from their site... Hit him in his wallet. If you could prove that he is stealing work you could theoretically shut down all of his internet sales. I would recommend taking the high road and not start a smear campaign, but then again it wasn't my work that was stolen. |

He has removed that painting from his collection. Does anyone have a copy of it?

You should of had some communication with the guy with regards to actually buying one of them, if he pulls it down now then you will have no actual proof he is selling your work.. get some screen shots of it for sale on ebay just to have some ammo dude.. |

To be honest I really aint bothered abou the money as much as the principle. I want to get people like this punished. Thats why I would like to rubbish his name instead. Matthew - what are the implications? |

well
I got the call from the man himself
He was actually very cool and we had a great chat about things. He said he was asked to do a commision from an unknown source (maybe someone from DPC, u know who u are) he painted it, and sold it for $500.
he agreeed to pay 50% which is fine by me (it is mainly the priciple for me) and maybe we will work on more paintings togther in the future.
Anyway I am quite happy that we sorted things out
He even is going to send the liomited edition copy of the painting to me.
Comments?

Sounds like alls well that ends well. Two ways to look at it.
1.) He got caught with his pants down and came up with a viable explanation and suitable compensation.
2.) He's telling the truth and you've met a potential outlet for mutual creativity.
The important thing is that you're happy with the conclusion and that's really all that matters.
ETA: I'm the optimist and would like to believe it's #2.

Is he paying 50% of all sales on the photo? Or the $500 commission. Anyway glad to see you got something worked out that made you feel better. Cheers.

Gotta love a happy ending. And besides, you made a new friend of sorts. I hope that the connection benefits both of you in the future too. Personally, I like the image better than the painting. : )

It beats the hell out of having to sue him, that's for sure.
