Create new layer (if you mean data layer) isn't basic legal.

Leroy's right, creating a new data layer and adjusting opacity of this layer before flattening is NOT legal in basic.

Adjustment layers are the preferred choice, they are non-destructive layers that do not contain actual pixel data, plus it's easier to make changes to/get rid of adjustments in adjustment layers rather than when the adjustments are done to the image itself.

I am sorry for my ignorance. I never used layers (very rarely in advanced editing rules too) so was not awared of it.
