I Have a friend of a friend who had some lingerie pics made of her for her personal portfolio a little over a year ago. Someone has recently discovered that the pics have been placed on an adult pay site with out her knowing about it.

I have asked them if the model signed a model release form, but no answer on that yet.

I suggested that the model contact the web master at the site in the mean time to have the pics removed.

What can be done if she did NOT sign a model release form??

What can be done if she DID sign a release form?

it's simple. if she signed a release granted full usage rights, then she's got no recourse.

whereas if she didnt grant full usage rights, or signed nothing, then they must remove the pics, and legally, they probably owe her any money earned from those images, and possibly damages.

thanks, thats what I was kinda thinking....just need to find out if she signed a form or not....

Without a model release, a model has a host of possible claims against the content creator and anyone distributing or using the content. These could include the following:

--Violation of her rights of publicity, which cover the use of any person's image, voice, likeness or name in a commercial endeavor

--Violation of his rights of privacy, which prohibit the use of private information or images of any person

--Claims of being unaware of the age requirements or nature of the work, or use of the content

--Claims of misuse of the content

--Claims of libel or slander by the model regarding the acts in the content
