First thing to do ... get a patent.

can you patent and idea? or must they have a product to support the idea?

i dont know but this invention will bow you away...especially your breakfest

Documentation is all you need... details, examples, etc.

Patent office rarely sees anything physical, to my understanding. We're going through a patent at work right now, and it's nothin' but docs, baby.

also..its more of an idea than an invention...as it its a spin of ofalready created items...just altered

Nope, sorry. I already thought of it and have exclusive rights to it. I'm going to have to insist that you turn over all associated documents and notes to me. :)

Ok, maybe not. Still, you have to refrain from referring to yourself as "someone" as you did in your original post. If you're going to be rich, you must refer to yourself in the third person at all times. (I read that somewhere.)

Next, when you manage to get your invention into production, DO NOT get yourself caught up in doing one of those late night infomercials. (Without inviting the rest of us to come take pictures.)

Finally, if you're serious about running with this idea, I recommend a lawyer (patent lawyer, probably?) and lots and lots of research.

Patents are useless! there is no real protection unless you are wealthy enough to sue everybody that infringes it. Besides some patents expire.

this reminds me of that dude who sells bottle caps (?) and used the name "pocketpc" for them. he sued microsoft for using that name on their smart devices. and that may be the reason why microsoft changed to "windows mobile" now?

Nolo Press has information on patents and other aspects of IP law -- their information is typically useful and accurate. They've been publishing books which help people do their own legal work for over 30 years.

Actually NO! If one has a patent and a clear violation exists, I can assure you that there are oodles of lawyers who would gladly take the case for a percentage of the claim.

Besides, if patents were indeed useless, we would see no need for patent offices which are quite busy.

Yep, but it is very different when we are talking about commercial names. If it is already registered there is nothing you can do, well either pay the other guy out or just change the name. If I remember correctly gmail was already registered in UK so there is google mail even though you have gmail on your address.

that makes me think - will we run out of commercial names some time in the future? it's like when you try to sign-up a new account on hotmail, everything's taken!

Go to a good University and they should have a business incubator, it is a good place to start. Just don't let them take the credits.

and from what I've heard DO NOT ever use those invention assist services you see on tv. From what I've heard, they (ok maybe not all but I bet most) will take your idea and totally run with it. Leaving you with nothing.

Good luck on the invention, I hope it doesn't turn out like the many I have had (including the Hubble telescope, except mine was mounted on the moon...yep that was my idea, ask my dad). My problem is, I think of them but don't do anything about them, then low and behold they come out with it within the next year. :) Really sucks, I could have been a gazillionaire by now lol.
