I will say that the cats are definitely in charge here. I only get to live here because I feed them. :-)

OK, I've been gone all evening so I'm just coming back to this thread. Let me answer a few questions.
1.Maybe the woman didn't know what a CF card was, but she should have since she was the photo manager. The original photo with all the EXIF data was on it.
2. They did not offer me the choice to sign a release saying I took the photo, they just told me I couldn't have them unless I had a business card or something on letterhead. I would have no problem signing a release since I'm obviously not going to come back and sue them for printing my own photos.
3. I understand "CYA" but this was more than that. This was sarcasm at it's finest.
4. To notesinstone - If I make myself "part-time" and give them a letterhead, can't the IRS come after me and say "where's the income from this part-time business?". This is my biggest concern with just making something up. I'm not a professional, I make no money from my photography (well, once I made $75, but only once).
5. To alfresco - at first I was flattered, until it turned into a backward insult.
6. Though I have heard of Costco, there are none around here that I know of.
7. If I missed any questions, let me know!
The part that gets me is that they didn't offer to let me sign the release the first time I was in the store. Just told me I couldn't have them. After going back with the camera, showing them the original on the CF card, then they offered the release. If I hadn't already paid for them online, I would have told them to shove them. |

Only if your making money. If your not making anything, or charging anything - then theres nothing to tax you on. And I'd have to check with my accountant, but I think theres a minimum you have to make before you owe taxes (couple hundred bucks maybe?).
Seriously - I do a LOT of volunteer work with my camera. I do a lot of freebies for single moms. If I never charged someone for another photo again I would still consider myself "professional" and I would still have a business card stating "photographer" because its a good thing to give to park Rangers and Fish and Game guys during hunting season (or to leave in the windshield of the jeep with my cell in case I dissapear out there). My release isnt on letterhead, its on a printed booklet FAQ about the best places in my area to print your photos. :)
There are plenty of professional photographers out there who barely know wich end of the camera to point - and there are lots and lots of professionals who just do it for fun and enjoyment with an occasional stint of being talked into a family reunion photo. The IRS isnt going to tax your ability or the fact that you call yourself a professional photographer, only the amount of cash you make if you sell your photos. :) |

They happen to be the only decent one hour printer within a reasonable drive. I also happen to not have money equivalent to the talent you take for granted that I have :) (I don't have the talent, either, by the way.)
By the way, these were not fine art prints being done to hang in a gallery, okay? These were for the mother-in-law, for crying out loud, who could care less if the color is perfect or the sharpness is incredible. These are her grandkids. Why should I pay 3.99 plus shipping and handling when I can get them for 1.99 plus tax? Duh?
Sorry, sometimes I take snapshots too :) They just happen to be better than some folks' snapshots; that still doesn't make me want to pay double and wait five days.
In case any of you don't understand my involvement; I'm married to karmat (Karma) and she goes through this on a regular basis. Yes, it's our fault for not being prepared, but these gooks have never really given us a way to BE prepared.
To all of you that are so proud of Walmart for protecting your copyright - they are NOT protecting your copyright. They are only covering their corporate butt. If your copyright is violated, they will simply say "not our fault". That means they are of no help at all. Yes, this would probably prevent a low-income mother trying to get her Olan Mills proofs copied for 0.19 or a bride ripping off her wedding photog, and that's good. But THAT is not their concern.
Clara - I understand what you are saying. You see a lot of crooks, criminals, liars, and cheats. That's sad, and I appreciate you guys trying to be honest and do your job right. It was a little disappointing for you to get so grumpy with me about it, though. I don't have air conditioning at work ANY of the time! :) |

I'm not sure how any lab would guarantee that, based on your stated policy and the pressure on the employees, without a contractual agreement of some sort. Different employees, different reactions. Is there such an agreement available for poor podunk people like Karma, who takes really good pictures but doesn't have good access to a good 1 hour lab for quick stuff?
By the way, we highly prefer using Adorama, period, but don't always have the luxury. |
