Originally posted by PhantomEWO: Wow, pretty energetic for an 85 year old guy ;). I believe we have been told that DPC will never use or allow archived or submitted photos to be used knowingly? If it is invisible and no-one can copy it what is the issue. If it ever shows up somewhere with a copy date or after the "cloaking" then you may have action if you can show it came from dpc in any manner. With upwards of 1000 submitted challenge photos and thousands more every week, can image the job trying to make everyone happy. I do believe that the photog should have the option to "hide" any of their photos at any time. Integrity of old challenges ... well who cares, just too many submissions to do what you and a number of others have done. I believe if you resign all your photos will be hidden except for ribbon winners and then it's just the rules that we agreed too. Maybe not correct but we agreed. |
The fact is that it is still on the servers, which is not somethingg that I want. I want the image removed from the servers. I don't care if it's hidden or not. |

Dude (mind if I call you Dude?), it's seems to me that you don't like it here. No one is keeping you. You're free to go. |

Just to clarify, practically everyone on SC has done everything in our power to rectify the situation here. We immediately removed his entry from the challenge, and hid it from the results for when the challenge ends. Technically speaking, yes, the image still resides somewhere on the server, and that's out of our hands as SC members.
The general DPC populace has no way of seeing the image. I'm not sure what the original poster's beef is, or what on Earth he thinks we are fiendishly planning to do with this shot, but we've done our part to take it down.
My best advice is that if you don't want something to appear on the web, then by all means DON'T PUT IT ON THE WEB. Once you put something on the web, it is essentially there forever in some form. Anyone who voted on that image, for example, likely still has it in their browser's cache. That's just the way the Internet works. Think hard before putting something up on the web that you'll regret later for whatever reason.
This article may give you some more interesting reading along those lines... what's posted on the web is essentially posted for good! |

So in legal terms, does this mean DPC can use our photos to further it's operation or marketing? Has DPC EVER given, traded, sold, leased, rented any photo without the photogs approval to any other entity for any reason? |

I'd say that about covers it. |
But the terms of service itself is revocable, and though i have requested it, they still won't remove the image. |
You submitted the image under the pretenses of the terms of service, which means that the image is bound by that. Your 'revoking' of the terms of service for you personally does not affect that image, just your account. |
You should read the terms of service too... It says that if I write to revoke it, then they must remove all images and information from their servers. |

The bottom line is that no one who has posted in this thread has the ability to remove a photo, even if it was allowed by site policy. The two people who can do this have been informed, and nothing can or will happen until they choose to make it so.
Continuing to harrass the rest of the site and the membership by abusing the forums and disrupting site functioning by distracting the membership and SC from their normal activities, also prohibited by the TOS.
Note: using the site features (like the forums) constitutes express agreement to the TOS -- you can't "revoke" them unilaterally and then continue to use the services. Maybe our lawyer should call your lawyer after all ...
I suggest we all go about our business now until Langdon reads his messages, since there's nothing else to do here.

This is the coolest thread yet - LMAO - I think I must also take legal action against DPC - THEY ALLOWED ME TO ENTER MY CRAPPY IMAGES INTO CHALLENGES. That is total neglect on their side. How could they allow my images to be uploaded for everybody to see.
WARNING everybody - you might view one of my images before any prior warning.
DPC - YOU ARE IN BIG TROUBLE...
:-)))))

Phantom ( I think that is who asked),
I've been here since way early on, and no, I don't think that has ahppened. The closest would be the newsletter where the top three are "reproduced" and announced each week. |

for some reason this whole thing reminds me of the warning you see on bags of peanuts sometimes: "Warning! Contents may have been processed in a peanut processing plant!" |
