a photo of a performer from a free public event as a framed and matted art print?

I believe you can, if it was private use in a home, office, etc. Not if it was used for advertising and the such.

How big of a performer?

Edit: the reason I ask is that many celebs have "copyright" on thier likeness.

Yes, but not for stock or advertising w/o a model release. Selling prints for personal use would be fine.
