I am often out and about and just take pictures of people. My sister in Los Angeles, the land of lyposuction and lawsuits, says that if I don't have their permission, I can get sued. For what? I'm not making any money off of this and I'm certainly not exploiting them. Is she correct? If that's the case, we're all in big trouble.

Sounds as if your sister has been assimilated :(
Photo-on sister Judy, she is incorrect as long as you're using the photos for art or journalism. |

The way I understand it, is if people are in a public place, you can take photopraphs of whoever, and whatever you want. |

She is very NOT correct. True, you can't use them as stock or for advertising. If they are in a public place, you pretty much have the right to shoot them.
Now, if said person was to ask you to stop taking thier picture, but you continued, you could get into harrassment issues.

As long as you don't sell their photos for profit, you can shoot anything you see in public spaces. Sorry sis.

You can sell individual art prints, same goes for IP trademarks in photos.

I always suggest people check out Your Photographer Rights by attorney Bert Krages. Download the PDF and keep a copy or two in your camera bag. |
