I'm helping a friend layout her child's grade school yearbook. She wants to include a year in review spread. My questions is... Can I legally use photographs (like AP photos) that I download from news sites (like CBS) in the yearbook? Someone told me that if a photo, article, etc. is used for educational purposes you do not need permission to use it as long as you give credit to the artist. No profit is made on this yearbook, it is just for the kids.

Even for a nonprofit, I think you'll be taking a HUGE chance. Get permission first.

Thanks strangeghost. I did a little more research and it seems the rules have changed and permission is necessary. Unfortunatly, the final layout is due in two weeks, not enough time. It's too bad, it would have been a great way to get the kids talking and thinking about the news and history. We're just going to leave the year in review out of the yearbook.

Doesn't look like nonprofits get an exemption.

Could always get the papers and magazines, lay them out "artistically," then take your own picture of the montage.

I think dacrazyrn's suggestion would still count as unpermitted reproduction of copyright works.

I also believe that the "fair use" provisions under copyright law refer to actual educational work (writing papers/theses/articles/educational materials) - it isn't carte blanche for educational institutions to do whatever they feel like with anyone's copyright material.

Some people would say "who cares? they won't catch you so do what you want" - but would you say that if someone else did that to one of your images that was potentially money-making for you? Check the sites' copyright policies (in case they DO give permission for re-use, you never know!), otherwise contact the sites and try to get permission.
