Is the photo filter adjustment layer legal in both rules?

I know it's legal in advanced editing and I feel it is legal in basic since it is only changing the tone of the overall picture. I just looked in the Photoshop CS bible and it stated that it's "adjust tone" so it's not removing or moving or adding any pixel data. So it should be OK.
