The NSA surveillance in question is limited to calls that originate or terminate in the US and does not extend to call made withing the US. Previously they were only allowed to tap calls that both originated and terminated outside the US.
Legally, they are supposed to get a warrant from the FISA court. What I don't understand is why they would feel the need to circumvent the FISA court, since the court basically greenlighted every warrant presented to it and since everything the court does or says is classified, it's not like anyone outside would know what was going on anyway.

I guess I interpreted it that way (that blogs etc. wouldn't count) because, to my mind blogs etc. aren't specifically communication devices - blog = web log = simple log or diary or record of a person's thoughts and opinions. Certainly many writers realise (and even hope) that their blogs are read by others but they are not actually targeted to a specific reader - the reader comes to the content and chooses to read it rather than receiving a communication sent to them.
I don't know if the rulers will make this distinction though.

Henceforth, whoever anonymously votes me a 1, 2 or 3 without leaving a comment, be prepared to hear from my lawyers. I'm annoyed, dammit!
