Yeah, I have no sympathy for people who don't read the challeng--- uh, I mean auction descriptions thoroughly. ;-)

$611 and this guy was really blatant that it was an empty box. people are SOOO stupid. rtfd, man. rtf description. $600 is not something to play around with.

Agreed, and the box auction specifically stated that it was only a box. Plus, it had a $5 starting bid, and only the bidders took it to $611. However, if the seller was going to be 100% honest, he/she shouldn't have listed the auction under video game SYSTEMS... That doesn't negate the stupidity of the buyer, but that does make it at least a little bit shady...

The people selling this knew exactly what they were doing... :/ If they were not trying to deceive people they would not have listed it under games/systems....they would have put it under picturs somewhere. Some people are real losers....

EDIT: Just went and read 'rest' of the posts....Harrison...you knew this guy and what he was doing??? I see your young...and I have to say....if your parents have taught you this is 'okay/normal' ethics I would have to say I am so saddened by this total lack of regard for mankind. :(

I dunno about anyone else, but I'm so careful in reading every single word of the description at least 5 times before I bid. I don't believe people could fall for that! As evil as the scammers are, I still find it quite funny :P

eh, one of the oldest ebay tricks.

"Why not remember this craze with a picture? Up for auction is a 4x6 photograph of the brand-new Microsoft Xbox 360. As a matter of fact, we'll even send this item to you overnight. And you know what's the kicker? We'll give it to you overnight for FREE! That's right, a Microsoft Xbox 360 pic with free overnight shipping!"

Clearly says what the auction is for there. However stating all the statistics and capabilities of the game console is definately a mask. The user should be banned for doing this type of thing. However, i'm not sure that ebay can do anything for the buyer after the fact.

Don't you need a "model release" if you sell a picture of a copyrighted or trademarked item (or something with a design patent)?

The buyer could claim a copyright violation if Microsoft had protected the look of the X-Box.

lol I have seen these a bunch of times, mostly one line of type hidden in a paragraph of type saying you are bidding or will receive a list of how to get this and other items for free. A lot of ebayers dont read all of the copy and see the price and bid right away. My old boss got caught by these trick when ordering a 1gig cf card. I could not believe the price he told me so I kept reading the ebay posting and after like three times of reading it I saw the oneline stateing that he would recieve or bided on a list of how to get this item free. Kind of sucks but he called his credit card company and told them to stop the payment.

Also I saw a lady recently on the news that bided on an Xbox 360 for her kids and got a list of how to get it for free too.

I wonder how many emails the seller got from interested parties?

Actually this could be considred illegal.

It's false advertising. It was put in the video game systems section, not photo prints. It claims it is an Xbox 360 in platform, and has Accessories, Game(s) bundled with it. In the actual description he was careful to make sure the specs were listed for the product, and not the photo, but he still goofed on the ebay description settings.

False advertising is illegal. That's all there is to it.

Getting back to the seller for a moment. Check this more slimey version out. Same seller- different approach.

In any case, it looks like ebay squashed each of the users pulling this trick.
