Is Nik Sharpener legal for basic?

It doesn't create a new layer - so that's ok.
It affects the whole image as much as USM does.

But is it legal? Please answer?

Never heard of it. What is it? Standalone? Plugin?

Generally, if it applies the effect to the whole image without making a selection, it ought to be OK.

It's a plugin that works sort of automatically - I think it reads the image somehow, determines the contrasts and then applies a USM, but I could be wrong. It's almost always dead on for sharpness, so I'd LOVE to use it.

Sounds like it may be legal in advanced editing but not in basic. Because it says:
Sharpening depends on many different parameters (and even more)

Target (size, device, DPI)
Quality of the original
Detail of object/subject
Viewing distance
Different sharpening for different parts of the photo
What you see on the monitor might not what you get on the printer

The different sharpening for different parts of the photo would go against basic editing rules. In basic editing it would go against:
Filters:Any filter permitted by this rule must be applied uniformly to the entire image.

It's most certainly legal for advanced, we'll need to review whether it is legal for basic.

There are a lot of sharpen programs (plugins, scripts, actions & techniques) really not many of them has been ruled upon as legal for basic on this site.
The standard reply for illegal is if mode in layers is changed from normal then it is not kosher. Some programs don't leave a trace of what has been done.

I see no reason why we couldn't generically allow ANY and ALL 3rd-party sharpening solutions with the proviso that you plug it into the whole image without selections and let it do its work. I mean, this is basic stuff. If your image is coming out of the camera sharp enough, it's because the CAMERA is sharpening, makign decisions on its own. And we have no "control" over how that's done, just how MUCH of it is done.

Neat Image is legal, for example. How many of us know just what goes on behind the scenes with neat image? And it can be used as a SHARPENING tool only if you dial down the noise-reduction part to zero...

If Neat Image is legal I think Nik Sharpener and like programs should also be legal. the caveat is that it must be applied equally to the entire image, no selections or layers, etc.

It's not as simple as "all allowed" or "all disallowed." The rules state that we cannot use layers, masks, or adjustment layers applied in non-default blending mode. The trouble is, some 3rd-part sharpening tools are actually actions that do just these things. Just becaue something is packaged up as an action doesn't make it legal, however. If it did, we'd need to allow everything and anything, because anyone can creat an action.
Still, we need to be flexible in allowing new tools, since these tools are intended to provide simpler-to-operate, yet more sophisticated (read better-performing) filters. Maintaining a realistic, usable definition of "basic" editing will be a challenge.
