I'm still fairly new at this and I don't want to violate any rules. I have a portrait I was considering, but unfortunately it contains a particular hand gesture that some might find...offensive? Would such a photo be DQ'd for content? Would voters score lower because of it, do you think? I'd be greatful for any input. Thank you.

under the user agreement

"4.2 You will not use the DPChallenge.com Service to post content or to design, manufacture, market or sell a Product that (i) infringes the rights of a third party, including, without limitation, copyrights, trademarks, patents, trade secrets, rights of privacy and publicity, (ii) is libelous, defamatory or slanderous, (iii) condones, promotes, contains or links to warez, cracks, hacks or similar utilities or programs, (iv) contains explicitly sexual content, (v) does or may denigrate or offend any ethnic, racial, gender, religious or other protected group, through use of language, images, stereotypical depiction or otherwise, (vi) is designed to or does harass, threaten, defame or abuse others, (vii) exploits images or the likeness of minors, (viii) encourages the use of drugs or the under-age use of alcohol or cigarettes or (ix) is generally offensive or in bad taste."

So if you do it and they find it offensive you could be disqualified. and from what I see possibaly baned from the site for violating the terms of use. I would err on the side of caution on this one...though I can sympthise with giving certian political messages the finger :)

I didn't see a thing in there that covers hand gestures.

this one wasn't DQ'd in the Communication challenge. as far as i know, the rules haven't been changed since then.

There have been plenty of offensive (to some people) images posted in challenges - i.e. suicide depictions (slit wrists, handgun to head), drug use simulation (imitated lines of coke, etc...).

I think a hand gesture is probably safe (unfortunately) under the rules.

However, now everyone knows which image is going to be yours and people DO vote down for that. In situations like this, where you need to find out if your photo is legal by giving away specific details of your images...I would contact a SC member directly.

No they don't because I am using an image of the same genre out of solidarity and in the promotion of free expression.

True - anonimity may be gone, (although maybe not ;-) thanks nsbca7) but I didn't expect any winning scores, so that's cool. I rarely photograph people, so this challenege is a real challenge for me.

Since you like the smile, is it in a way that you can crop out the hand?

Good thought mystical princess, but alas, it's a horizontal shot and the finger is covering most of his nose. I might just have to go with plan "b" and put this particular shot in an outake post. At least I know that for future challenges I could most likely get away with it and not be DQ'd...as a newbie I don't want to break the rules too soon.
