May be a Stupid Question but I'm stumped.Today I was in the park, There was a guy sitting under a shelter, I thought it would be a nice pic. should I take it without his permission, or should I even ask??

In most cases just take the picture [don't be obvious]. If you feel like you may be infringing on his privacy, just ask him but when you do the mood of the picture has changed IMO because no he has gone from a candid shot to a posed shot. In most areas you have no privacy in a public place. But it is a judgment call.

That is up to you.

What I do is take the picture without him seeing then I go ask if I can take the picture. If he says yes I take a few more. If he says no I respect his privacy and delete the one I took.

It may seem a little sneaky, but I think it is an honest aproach to taking a candid shot. Might buy the guy a sandwich afterwards.

You know, you just never can tell what damage you might do to someone in that condition if the wrong person sees the picture. He may be in a transitional state and doesn't want his 12 year old son to know his father is a bum. Or his wife or his classmates or mother. You never know what a person has been through or how fragile they may be without actually being them.

You can take someone's picture in a public place, but if they can be recognized you need a written release to use it commercially. Legitimate journalistic, educational, or personal use is allowed without a release.

I'm done being nice. If you're in a public place, and I want to take your picture, I'm going to take it. If you want privacy, don't go in the public and if you have a problem with it, bring it ;-)

heh...just kidding, well sort of. But seriously, people in public places, in plain view of the public eye have no reason to believe that anything they are doing is private. Snap away.
