I feel like this image fits the word of the law, but not the spirit of the law. Nothing in this image tells me 4-5am. I completely believe that you took it in this timeframe, but the image doesn't make me feel anything.
Its a well executed image and so I will give it a nice score, but it will not be rated as highly as those images that also expressed the time frame.

Definitely a very difficult scene to make look nice in this type of light. You have a good use of S-curves with the path, and a nice amount of colors. I wonder if you could have brought out a bit more detail in the shadows to mellow out the bright/dark spots a bit more.
