it defiantly seems like it is the same as this I wonder if she submitted it and if not how the hell do they get off putting their logo on it.

after looking at it more it is the same, sent her a PM.

Well, looks like whoever put it in likely made 25 bucks for it... hope it was her, not a thief!

If you save both images, open them in PS, copy the DPC original and paste it over the dupe, blend adjust to 50%, edit, transform, scale until they overlap, they ARE the same image. The break.com version cleaned a couple of spots out of the left side ripples, but the patterns, shadows and shapes are an impossibility that two could be identical.

I rarely call out something in public like this, but the proof is there.
Well, I hope it was IreneM that submitted it, and not a thief. Happens so often I may have jumped the gun - certainly hope so.

the proof for me is the tiny milks spot at the base of the splash tower. it couldn't be there in two different shots.

I think they might be catch lights from two speedlights lighting the shot from both sides. Obviously it is the same photo but that double highlight is a fairly common one.

not the catchlights further down it is some milk (i tihnk) doesn't matter anyway becasue they are the same.

welcome to the intertubes!!

if you want to guarantee that nobody steals, copies or reproduces your photos, then don't put them online.

sadly ...

theft is rampant and with over a billion websites, how the hell are you going to know about it?

i think they're definitely the same shot. just a matter of who submitted it to the site!

If it says it was "Submitted by Break.com" (as opposed to some other member?) - does that mean the website owners just go around plucking copyrighted material and posting it? Then just remove it if someone notices? >:/

Their reaction will prbably be to simply remove it. This seems more like a policy of theft rather than an isolated incident. I would question the rights of all of their content.

Other than asking them to remove it, I would also send a note to their source of advertising, Adbrite.

As well as their hosting service //www.rackspace.com/

Shut those bastards down.

They do say this in their terms:

"Your Materials shall not infringe the copyright, trademark, publicity/privacy right or other intellectual property right of any third party."

So they should act against it.

they wont act against it ... they'll only deal with complaints that come in ... sites like this never give a rat's ass about people's copyright. they only include those kind of statements to protect themselves from being sued.
