Copyright infringement and a medieval apple pie

What will become a classic piece of writing from the editor of Cooks Source Magazine

“Yes Monica, I have been doing this for 3 decades, having been an editor at The Voice, Housitonic Home and Connecticut oman Magazine. I do know about copyright laws. It was “my bad” indeed, and, as the magazine is put together in long sessions, tired eyes and minds somethings forget to do these things. But honestly Monica, the web is considered “public domain” and you should be happy we just didn’t “lift” your whole article and put someone else’s name on it! It happens a lot, clearly more than you are aware of, especially on college campuses, and the workplace. If you took offence and are unhappy, I am sorry, but you as a professional should know that the article we used written by you was in very bad need of editing, and is much better now than was originally. Now it will work well for your portfolio. For that reason, I have a bit of a difficult time with your requests for monetary gain, albeit for such a fine (and very wealthy!) institution. We put some time into rewrites, you should compensate me! I never charge young writers for advice or rewriting poorly written pieces, and have many who write for me… ALWAYS for free!”

To link it to photography, it appears the mag has been stealing some photos as well.

I ran across a mention of that debacle yesterday. That editor really has some brass cajones.

Here's a couple more articles and Cooks Source's response

ok -- but what's driving me up the wall is: everyone keeps misspelling "defense". They've been spelling "defence." Including the editor!! I guess they're going to go remove all the fences.

I didn't realize that it was a free newspaper. While it's still wrong, it's a little more understandable that you'd have an editor that was clueless.

This sent me into a fit of giggles, dear Grog. I grew up in Mexico... "Cajones" (with an "a"), means boxes or drawers. I do believe the item you meant was "cojones", with an "o".

*Goes off to giggle some more*

"Defence" is also correct.

I do love that this rather foolish editor, Ms Griggs considered the historical spelling in the original article to be spelling errors in need of her editing talents.

The resulting backlash that has hurt Cooks Source Magazine, tells more about the possible risks of bad manners and snippy responses than copyright laws. If she had only been polite in her responses this would never have happened.

As Buckaroo Bonzai said "Remember, be nice. No matter where you go....there you are."

ah... I knew I should have looked it up before posting, but I was too lazy. It says it's "chiefly British". So I will now go write my thesis on "Defence of the colour grey."

:D

That's what surprised me, as well. If someone's accusing you of copyright violations, first, you talk to your lawyer & find out you're wrong. Then you nicely try to get the person not to sue.

Why would she be so inflammatory?

I think one of the reasons she got screwed so hard was cos of her response.

I bet we wouldn't be hearing about this is she had paid up.

bet she wished, she had taken Miss Manners course now

i had some time to kill and, needing a little entertainment, waded through some of the outrage this spawned. this has got to be one of the most incredible village burnings of all time...

I'm kinda shocked they haven't shut down the Facebook page. It's sad people steal images so much, like the photog who used other peoples images on their website and advertising caused a big stir on Groupon. I always wonder how much of my work is floating around out there being used by other people. I know there was a website where you could find out but I can't remember what it was.

The editor probably thought she was in the position of strength and that the writer couldn't do anything. Not sure though if she honestly thought she was right or if she was just being defensive. It does sound as if she was running her magazine on a shoestring and taking content for free from the internet.
