Well, after 7+ years I was finally lucky enough to have a photo stolen. Makes one feel happy doesn't it?

did you tell them you knew it was yours? i know people always say its the biggest compliment, but it always bothers me

to do a screen shot - ctrl, alt, prt scr, open up paint or similar program, edit paste save as jpg windows anyways

If you view the image by itself (right click, view image) it still has the DPC copyright tag as the file name:

//www.jb-machine.com/Copyrighted_Image_Reuse_Prohibited_813.jpg

That does crack me up... that the phrase "Copyright Image Reuse Prohibited" doesn't ring a bell for these folks :)

Well, then instead of asking them to remove it, just ask them to give you credit for it. Of course, they are getting free stock photography out of it, which I'm sure will bother some people, but that is your choice. Just my two cents

Nothing is added to the EXIF. The file name has the language prepended so that when someone goes to save the image on their computer the filename will include the copyright statement.

That's how I found it; I occasionally google "copyrighted image reuse prohibited". :)

Some folks are simply flattered, some don't care where/when/how their shots are used, but if it were mine it would definitely depend on how it was used.
For example I found one from DPC a while back on an extremely rightwing fundamentalist "Christian" site, complete with racism and homophobia. It's definitely not somewhere I want any of MY photos associated with. And if you're claiming that my work is yours, not a chance. If you're using it to mock someone, nope.
If it illustrates your poetry, sure, but please add a credit :)

Sigh... I've only had one used, which is rather sad, and she was just pulling anything she liked into a webshots album. She got really nasty when I called her on it, but at least webshots removed it.

Is there really anything you can do? What if you tell them to take it down and they say "sue me"? Will you sue them? How much are you willing to spend to sue them?

Other than them getting nasty emails from your friends here on DPC, I don't think anything will happen to them if they don't take it down.

You can report it to the webhost who will issue a warning for them to remove the offending image, I believe if the webhost does nothing or allows continued use of copyrighted material then they also open themselves up to prosecution (although I could be wrong on this).

Take a photo of the page with your camera and then you will have bragging rights also.

Prosecution? Damm...they can go to jail for allowing a hijacked photo on their website?

I don't run a web server but I can't believe that the "server owners" are responsible and liable for every picture that customers put on their site....and if so...it would be a civil matter and you'd have to sue them.

I'm not saying it would be cheap, but I do believe that once a webhost has been informed that they are effectively hosting copyrighted material that they then become liable to court action for want of a better word if they allow use of said material to continue. That's why when you report image theft / copyright infringement to the likes of flickr they will remove the image very quickly.

Can't be bothered to look for it but I am sure there will be loads of info on google, obviously different Countries / States etc will have their own laws as well.

ETA: Might be worth a look under Cease and desist?

No, I meant the jb machine site. The image had been replaced just before I posted it was removed. It is still removed. If you still see it it must be from your cache.
