Go DPChallenge.

Has anyone tried filing a lawsuit, or sending a warning letter, since you have already tracked her down?

Yeah Philly offers the world several things, The best Pretzels, Cheese Steaks, and it's own language.

Good catch! I can't believe how she has butchered those gorgeous images (compression?)! She needs to be drawn and quartered.

I left messages with a few there who were supportive before, letting them know she was still up to her old tricks.
Btw, one of them even joined DPC after coming over to see where the shots were stolen from :)

Oh, and Hye5, thanks for finding those. I check out Mozingo's work regularly and try to track down originals, but haven't had much luck lately. I'm glad I'm not the only one who wants to see her stopped :)

I try to check once in a while as well, mostly out of curiosity. Nothing has really looked familiar until I noticed his/her Bugs gallery. I knew I had seen something similar linked from a recent thread on DPC. They are amazing photos and really stuck out in my mind the first time I saw them.

to me, this is a "valid" use of the pictures. He tells the photogs name, and in at least one instance links back to the photog's port. Kinda like free advertising.

I've come across a couple of mine in blogs and whatnot. That doesn't bother me because in most instances they were not claiming the shot was theirs and was not profiting off of it at all.

the ones that claim the shot, offer how they edited it and have it for sell really make my skin crawl

I just asked him to remove the link. I don't care if it's OK in most users eyes. It's not in mine. I sell images for a living and it can be a breach of contract if they are all over the place. The big issue is, others can take it from his site and post other places then it will spread even more and get outta control. I dont' mind the little link, but not the monster sized pic there.

Thanks Karmat. You SC are really pretty awesome!

And in that situation, yes, I would be all for asking for images to be removed.

I'm not quite clear on this. What if the guy says no? You don't really have much recourse do you?

Are you asking just for the sake of argument? Of all people here, you should know copyright laws being such the accomplished photographer that you are.

What is not clear about copyright laws? (Other than no one bothers to read them) Linking to it is still copyright infringement, It caused another copy to show up somewhere other than the original posting of it.

Many don't give a damn where their stuff shows up. I do. I also know if I took seriously policing my images militantly I would never get anything else done. I sure do make contact when I do stumble on them, however.

Most people, if you ask nicely, will comply easily enough and usually apologize. If they don't, one recourse is to contact the site host or webmaster. After that, one can (and usually has to at that point) get much more creative if necessary. Invoices can be sent. Letters from lawyers can follow. It merely depends on how much you want to pursue it and how much time, energy and money you want to pour into it.

Personally, I'm flattered he likes it that much, however, it's the other people that see it there that are gonna pilfer it and start to call it their own. That's what I'd like to avoid. I realize they can do the same from DPC but at least it's just one less place others can grab it with a screen save.

That said, I sure wish DPC would find a way to implement watermarking after challenge and/or offer a way to block linking to images like Smugmug can. It sure would help those of us trying to make a living from them AND also have fun here.

No I'm not going to wipe out my portfolio and quit entering challenges. I know the risk. I usually don't have palatable enough pix for people to want 'em anyway. Mine are mostly made to earn a living, not be perfect and pretty eye candy. It's a nice treat when those two factors meet so well tho'!

Buuuuuuuzzzzzzzz! WRONG ANSWER. This is a gray area and generally treated as acceptable. Such 'Hot Linking' is what allows us to discuss images here on DPC the are hosted elsewhere. There is a small and militant group that feel this is wrong, but they are a minority.

What you aren't answering about Jason's statement that he is specifically asking is if the Poster refuses to take down your image from his Flickr/Webshots/whatever page, ARE YOU PREPARED TO SPEND HUGE AMOUNTS OF MONEY HIRING AN ATTORNEY FOR ZERO MONETARY GAIN? 99% of us would likely say, "No." Hence no recourse.

That's my opinion on both accounts.

1) We link pictures from each other all the time here on DPC. While the TOS allows DPC the right to use our photos it doesn't grant the users the same rights. Are you saying everytime I post a thumb of an image on DPC that isn't mine I'm breaking copyright?

2) Even if it is illegal, and I don't think it is, I agree if they just say "no" then you are pretty well up the creek.

*throws up hands in disgusted resignation*

I give up on getting anywhere with this thief and fraud at Webshots. The only place I can find to complain is if it is MY shots she's stealing. The only other choice is to report each and every shot individually, which I did for the bugs yesterday but have had no response yet.
Now I notice that she (oops, HE, sorry) even had an album featured on the homepage in January containing, surprise surprise, stolen photos.

If Webshots hasn't done anything in 6 months, they're not going to.

Can't you report Webshots to whoever is providing the webspace? They have conditions they need to abide by.

They're a division of American Greetings... I think they're probably a big enough company that there's not a lot of recourse?

Oh really...so big companies don't have to answer for their illegal goings on???

Of course they should, but how often do they? :(

I'm pretty sure a spam I got from them the other day showed the CNET logo with several other associated companies at the bottom of the page. Unfortunately, I unsubscribed and deleted, so can't check.

If they're all tied in.......? I dunno, it's midnight and I'm braindead. :(

eta; ahhh, I FINALLY found ONE page in there that mentions CNET, and had to be logged in to get to it... but is that even who/what I want? See, that's why I gave up. I'm a dummy :)

OMG!! I'VE BEEN STOLEN TOO! That's an absolute first for me, as far as I know!

I searched Webshots using "reuse_prohibited", and found a bunch of horse shots, randomly clicked one, and didn't even realise at first that it was my own, that's how little I expect mine to be stolen, lol.

horse

eta; there's also a few other folks' stuff there, besides what belongs. I'm contacting those people, in case they're interested.
