On a photographic note, I was in a minor accident a while back and asked the attending officer what I should shoot besides the damage. He said to shoot the license plate numbers of both cars so the other party couldn't claim they weren't there. Also try to get a shot of the other driver to place them at the scene, and shots showing both cars in the area where the accident occurred. Try to include some context as to what happened (e.g. how far you were from the yellow line/parking space/curb etc).

It's pretty interesting that the driver's insurance representative wants to come talk to me in person as soon as possible. I made it clear that at this point I just want to start the processes of getting my truck repaired/replaced and getting my ER bills submitted and I didn't think that needed to be done in person. He said he wanted to talk about my "personal claim" (his words) first. I suspect they're looking to pressure me to settle completely as soon as possible to avoid any future expense. I'm really not the kind to unreasonably take advantage of a situation like this but I'm not signing anything away until I know I'm well either.

The cynical side of me says that the insurance rep wants to record your conversation, and will start with "how do you feel" to which most people answer good or great or OK because they don't want to get into a conversation about their health with a stranger. Then the agent has a record that you feel great, even though you have soft tissue damage....

Just have someone else tell the insurance agent that you're in too much pain to talk to him. I find that its always painful to talk to insurance agents :-)

I agree. follow the advice given. the insurance company has a lawyer so should you. your lawyer will take half or more of what you get over your bills but the peolpe i know that didn't use layers ended up paying more out than they got in.

And even though you may feel pretty good right now, don't be too quick to say you're fine. With soft tissue damage you might feel a lot worse in a couple days than you do now, and it can take a fair bit to heal it.
So just make sure to take care of yourself as carefully as you are your vehicle :)

(and good work getting photos :D )

Please listen to this good advise. I was hit by a teenager with his brand new truck in my tiny car. I felt fine at first, but it gradually got a lot worse. Turns out that my seat belt cracked the bone in the chest(not the ribs, the one in the middle). The hospital didn't tell me until we asked why it hurt so bad to breast feed. As the days went by the pain was so intense, I could barely stand to be awake.

I didn't get a lawyer, but my insurance agent acted on my behalf. She know how messed up it all was because like you I had pictures and she is also a close friend. She dealt with the other agents for me and got all the bills paid and I recieved a huge settlement. I also had two years of physical therapy paid for more if I felt I needed it. Once she got involved things moved smoothly.

Just an idea if you have an agent like mine, but a lawyer is the best plan if you can afford it. :)

Fortunately the other insurance company isn't questioning liability. They've accepted that their driver was to blame. They just seem to be in a hurry to settle. I don't plan to drag it out but I'm not closing the claim until I'm sure that I'm well and that all damages have been taken care of.

As with angel I have my own agent looking out for my best interest as well. I'm hopeful to keep lawyers out of it but I'm not ruling it out.

Thanks again for the advice.

No, of course you don't. The other party's insurance is gonna have to pay anyway. You do NOT want a vehicle that's had to be straightened, they never seem to get it quite right.

Actually, my Honda civic was straightened twice with pretty good results. Though I think the center of the uni-body was unaffected by both of those accidents. Alas, it has been run over again (I need a bigger car maybe?) and this time is totaled :(

Hasta la vista Civic, hello $3500 from the other dudes insurance.
