Read the FLSA. If they do dock your pay for not working 40 hours in a week, even once, you go to a good FLSA attorney and you get paid for all the overtime you ever worked because they had you incorrectly classified as exempt.

My boss can say I need to be "on call" from 8 to 5, which means sitting at my desk. He can then say that while I'm sitting at my desk I have to be working. If I do all my work, he can give me more to do. And no, he will not dock my pay. He'll just fire me. Then I can sue and try to prove that's why he fired me. Oh, that sounds like fun! I don't have to read the FLSA to know that it's just a unionbusting measure.

(dang, I'm sorry we're highjacking this thread, glad2badad. I was just befuddled and had to respond)

If your boss said that you can't be exempt and you should be collecting overtime pay. Read the FLSA before knocking it.

Wow. Sometimes I just feel so out of the loop its not even funny. I've probably been guilty of exactly what ' . substr('//www.dpchallenge.com/images/user_icon/21.gif', strrpos('//www.dpchallenge.com/images/user_icon/21.gif', '/') + 1) . ' glad2badad is talking about. Frankly I don't have a problem with tagging any topless or nude image as such and I don't have a problem with linking to any of these when I post in the forums. I do it on FM and I'll be satisfied to do it here (don't see what the uproar is about). I honestly hadn't looked at the forum rules in . . . oh . . . several years now. I'm sure there may be others who's posts are more egregious or regular but for whatever part I contributed to Barry or any other DPC'ers consternation over not tagging and linking topless and nude work I apologize. My mistakes were lazy tagging, an oversight in posting and won't happen on this site again.

I'm surprised that others don't want to follow a rule that apparently has been in effect for some time already.

Here's a question. Is there an option (or can someone add one) for implied nudes. I'm sure that the implieds can seem almost as provocative for a work or family setting as seeing the actual nipple or curve of the butt. I know that if I opened a browser in certain settings an implied shot would be in as poor taste as a nude. Having said that, I don't feel exactly right tagging an implied as a nude, though.

Are you annoyed by the increasing amount of advertising, thumbnails, animations and other junk cluttering up the forums in user signatures? Make them disappear! Just click here, check the "Hide Signatures" option, click "Save" and enjoy a much nicer forum viewing experience.

Is this a photography site any more?.. because...All I hear nowadays is OMG nudes OMG something rather...

QUIT COMPLAINING I am sick of it... this site use to be fun but all it all it is nowadays is whinging whining adults.. I thought you all knew better. Ok hate me for.. I'm beggining to not care... But all this controversy with all these nudes its getting really pathetic... How old are you people? If you people don't want to see nudes then click the appropriate box in your preferences...but be prepared for the odd one to show up...this is a photography site after all...I just thought being grown men and women you'd confront a person if they are annoying you..or offending you, but instead.. you go and talk behind their back.

That is something a 15 YR OLD would do. So WHAT if people want to do artistic nudes and want to express themselves in different ways ITS THEIR CHOICE NOT YOURS...GET THE HELL OVER IT AND GROW UP. Nude photography has been around since cameras were invented...if you don't like it...pack up your camera and leave!

I have nothing more to say...

And what if your child is looking at this site and this person has not flagged images as nude?

Except the debate is about how to TAG them, not how to BAN them. Some people care about this issue. Evidently you don't. But why whale on people who DO care?

There definitely seems to be a growing trend here.

I suggest DPC give in to the large vocal majority and simply ban ALL nudes. It eliminates the risk of easily offended people being traumatised. (And I'm not talking about the OP)

I suggest DPC scrap all the forums to eliminate the risk of innuendo that offends the large vocal majority. Just have the contest - enter an image, vote and see who wins. Simple.

A form of Sharia Law could be implemented...Don't know how you could make a code for it, but I'm sure there are plenty of people here willing to work on it.

I almost beg to differ Robert. Viable Solutions have been offered, but have mostly been ignored. It seems more or less people just want to gripe.

I think ' . substr('//www.dpchallenge.com/images/user_icon/user_id/1031.gif', strrpos('//www.dpchallenge.com/images/user_icon/user_id/1031.gif', '/') + 1) . ' GeneralE made the point a while ago, that he would rather his kids see breasts (which they already knew about, as all kids do), than guns and violence. I sort of agree, I don't think it'll hurt kids to see an odd boob here and there when they're looking over their parent's shoulder. They can't see boobs shooting people on TV and then go steal a boob and shoot their classmates with it..

There should be DPC Afterdark. That would be an exclusive club for nudity.

I am totally joking and just trying to get involoved.

Not true...what about a booby trap?

(Am I allowed to make jokes like that anymore?)

What I find funny about that statement is that she isn't much older than a child herself. hehe ... Love ya, Amy.

All the op was asking is for a rule that is already in the tos be applied. He's not asking for new rules to be made. He's not asking that all nudes be banned. He's not asking to have people jump all over him because he wants a rule that exists now to be followed.
Why are so many people not reading the original post and bringing their own agenda into the discussion?

What agenda's that?

1. Start debate about nudity and acceptability on DPC
2. Get new rules created that ban nudity
3. Revel in turmoil and disorder
4. ...
5. PROFIT!

The fine points still need to be worked out.

people calling someone a 15yr old because they don't want to see surprise nudes in the thread and such.
I am allowed to use company computers on my lunch break to surf. There is a company policy about adult content. There are employees that have access to what we have been up to while surfing. All I need is to be fired because I accidently pulled up a nude picture in a forum thread.

And if the answer is no... would it drop or will someone else take the podium?

Oh please... if you honestly think there's a chance in hell of going to DPC and sidestepping every nude you're kidding yourself.

If you can't deal with the fact that there are rules and terms of service here, just as in real life in nearly every other place adults might go/be/etc. in the free world, then perhaps you should take your own advice. Join a site that is all about nudity and art and all that for what it's worth. You are correct that this is a photography site, yes...but asking to enforce a rule that is already there is not a crime. Throwing a temper tantrum and screaming at people who are only trying to follow previously-created rules is.

There seems to be a suggestion that DPC/SC/Admins are somehow responsible for ensuring that you don't see nudes on this site when you're not 'expecting' to. This is a dangerous assumption.

It is up to individuals to flag their images as nude to prevent them displaying on certain pages. It is also up to individuals to ensure they don't post nudes in threads without some kind of warning, or turn them into links instead.

It is impossible for SC to continuously patrol the forums and galleries to ensure these nudity rules are being adhered to.

And what happens if you do get fired from your job? - Or heaven forbid, if your child sees a nipple? - Will you lodge a complaint with the DPC owners?

I do not believe DPC can offer any guarantee that you will not see nudes, or encounter any adult conversation/innuendo or anything else you might find offensive.

And you should bear this in mind if you make the decision to surf this site when you're in work, or if you allow you children onto this site.

At some point, someone decided that it might not be good to have nudes posted directly in the forums. They included that within the tos. I didn't write the tos. Nor did anyone who has spoken in this thread. I say that either the the rule should be removed or applied. If it is applied and the sc has to police for a bit, it will soon be followed without the sc having to waste their time. People will learn by experience that it isn't allowed. Also that is why the report post button is there. We are all empowered with that so if we find something offensive, we can alert the sc and all they have to do is make it dissappear.
I have nudes in my workshop folder. I do nudes for some friends. I find nothing wrong with nudes. And I don't think it is worth me losing a job I like because one or two people have a problem following rules. I only go to two or three different sites from work. I don't need to google anything.
