I do not care who or what you are, you will not use any of my pics to play with and then publish here or anywhere under your own name. You will remove it immidiatly and apologise! Who the hell do you think you are?

Not only Gibun's photo, but many others too get to be "treated" in the forums.
I find this tasteless and pathetic. And if you take someone else's photo and not even bother to make sure it's ok with the photographer - that's lame.
Enough is enough.

Oh, and Brad? I am not going to shit when I see your photo.
I am just going to feel very very sorry for you.

Looking at you profile it seems to me there are more victims than me! What would it cost you to send a simple PM to ask if you may? I am so pissed off I can tie my pants up with a rattle snake.

My pic, I react as much as I like, especially in the event of encountering those without the common decency to ask before they do what the do.

I don't think he's over reacting at all. If someone not only took my image without asking but altered it and then summit it back to the site as there own, I'd be more than just a little pissed. I completely understand what he's saying.

just seems like a silly over reaction for something that was meant to be lighthearted and certainly never meant to be passed off as someone else's photo.

I think its a silly over reaction too. A simple PM to the person who used your photo asking them to not use our photos in the way that seems to offend you is the polite way to handle this...
I for one would love it if someone found one of my photos good enough to borrow tho... and in the past others have borrowed some of the top photos on the site to have fun with, I would think it a compliment not a horror..
BUT, I do in a vague way agree that a pm asking to use the photo is also the polite wayto borrow a photo.

FWIW I think the very least that the person who used Gibun's picture could have done is acknowledge in the comments section what his intent was and that it was Gibun's picture (an explanation of the results). As it is I cant see what his purpose was to edit the shot in this way???

Just my 2c worth.

I think you may find those photos were used for another thread about hair. It's the same face that was used in those! I'd maybe settle a little bit and check it out. I'm sure nothing was meant by it!

they have the photo on their profile page under portfolio that to me claims it to be their photo. that or they dont know how to sort their page so it only shows pics they select.

Gibun,

I'd recommend taking a look at the manipulated photo in the context of the entire thread where the photo was posted, and I think you'll agree that the poster probably never intended for anyone to think it was his own photograph.

I know and understand you're upset; however it is not appropriate to publically call out another user in the forums. Probably a PM to the user request that she either provide a link back to your original or remove the photograph is all that would have been needed to resolve this. You also have the option to contact Site Council if you believe site policy has been violated.

Ah Terry if we only lived in a perfect world. I didn't see the picture, I don't know if the person tried to pass it off as his or her own but I know what it feels like to be raped. Just like this.

Whatever the gravity we may have given this issue or whatever the depth of a transgression we think it was, Gibun had a visceral reaction to it and took out his frustration here and we can't blame him can we?

I looked at the original thread; I would have removed every picture I had on this site if that happened to me. That is just plain wrong and I am surprised so many took part in that. I am also surprised that thread is still there to.

As far as the SC, I have sent a number of notes to the SC and only time I heard from them was to tell me I was mean and I will admit in that case they were right. But what happened to my other notes to the SC? I never heard a thing. No one ever replies or gives their conclusion. Why is that? When I send in a complaint it is like it is going into a black hole. I am sure nobody will contact me and give me an answer, that is why I so despise the SC. I have a problem with authority what can I tell you?

The thread should be removed before others find their images there and get as pissed off as Gibum. Doc has a point.

From my own experience, according to the SC (and I got this response from more than one), apparently it is OK to steal an image from here and use it for whatever you want...as long as you can claim it was in the name of humor.

Theft is theft!

As a US-based site, are we not bound by US copyright law?

US copyright law does include a "fair use" doctrine, which enumerates conditions under which copyrighted works can be used or modified without the permission of the copyright holder. One of those conditions is criticism of the work, which the courts have held to include parody.

Some insight on this is available from The Publishing Law Center.

This problem has come up on other sites...

One thing I noticed that works is that the admin post that it is not generally considered 'acceptable' to download and edit other people's photos -- without their consent.

If someone chooses that they want to allow everyone to download, edit, and repost their photos, they can put a disclaimer in their signature or in their profile saying it's ok -- but if the disclaimer doesn't exist, you have to ask.

Obviously, a solution there is to put a copyright symbol on your photos -- technically, anyone who downloads and edits your photo (with or without a copyright symbol) is violating your copyright...if your copyright is on the picture and they remove it, then it's just that much worse...being that most photos here are entered in a challenge, and can't have a copyright logo on them, I'd say the same should apply -- that is, people shouldn't be allowed to download and edit your photos without your consent.

I, personally, wouldn't like it if someone did it without asking. If you want to edit a photo that much, shoot me a PM and if I say it's ok then it's ok...

maybe the SC could come up with a post dealing with that and put it in the left column as a sticky or in the user agreement...in reality, some people do feel really strongly about this...and others don't -- that's why the opinions differ so much.

I don't see how adding someone elses nose to a shot is parody. They are not making a statement on the original work - they are using it for something else. How is that parody?

Look...no one is asking you to agree with any way of thinking...why can't you understand that some people just don't like to have their photos retouched and feel when people put them in their portfolio without being given credit, or putting them in the workshop where they're not visible, that they feel they have been violated?

Besides, no one's calling anyone elite or saying they're better than anyone or anything.

There is no need on either side to turn this into personal attacks. Anyone who would like to discuss this issue at hand is welcome to do so; however bickering and sniping adds nothing to the discussion at hand.

Now that's not entirely true, is it? The nice thing about the ticket system is that it tracks notes from users. Your last note received 4 replies, two of which were from me. Your last message was that you were going to work on compiling the information that we had discussed and would get back to me. I'd be glad to resend you all that communication if you've forgotten. That was January 12th and you haven't submitted anything since then. So perhaps you need to revise your memories of your SC-related communications.
