Hi All,

Please can you help.

I am being offered a picture of a famous person. This was bought by a dealer at auction and now the the dealer is selling to me. The dealer says he will give me a letter of transfer of ownership but tells me he did not get one from the original seller.

If I buy this pic will I have all rights to do what I want with it and use as stock?

No...you need those from the original photographer.

Nope, it's not about where it was taken, but who took it. The person who shot the image maintains the copyright.

ETA. Buying the copyright, full rights of an image is usually very expensive.

UK law may be different, but generally the copyright remains with the photographer -- it's only because the photographer can choose to restrict number of copies made that the print you are buying is worth more than the paper it's printed on (cliche intentional).

You may have a limited right to reproduce it -- for example, listing in a family history or insurance inventory -- but buying the print definitely does not give you the right to re-license it as stock.

That the photo was taken in a public place makes no difference (to your situation).
