Such is the law. I have never heard the term "patently obvious" within the context of a criminal case. There are rules for all and failure to meet established criteria usually give rise to dismissal of cases.

You also have to take into consideration the fact that the judge did ask the NFL for direct proof that Brady had cheated and that they didn't. Whether that is attributable to the fact that they couldn't or wouldn't is not something that I am in a position to address, but given an option I would tend to lean towards the former.

Lastly, here is what the judge had to say in regards to his decision: "“The Award is premised upon several significant legal deficiencies, including (A) inadequate notice to Brady of both his potential discipline (four-game suspension) and his alleged misconduct; (B) denial of the opportunity for Brady to examine one of two lead investigators, namely NFL Executive Vice President and General Counsel Jeff Pash; and (C) denial of equal access to investigative files, including witness interview notes,”

The issue before the judge was not whether nor not Brady was involved in cheating, but rather whether or not the NFL had provided him with a venue where he could effectively challenge the findings of the report submitted by those who investigated the matter. Those are de facto issues of law.

Off to the next round I guess.

Is there any truth to the rumor that Brady is going to replace Aaron Rodgers in those "Pump You Up" commercials? :-)

Probably not... that might best be left to the NFL commissioner and the investigative crew.

Now there is a group that can blow things up way out of proportions. :O)

The whole issue is water under the bridge and could have been six months ago. There exists a Collective Bargaining Agreement, which was negotiated in good faith by the NFLPA. However, it's time to play football and I'm not holding my breath for a conclusion anytime soon.

Strange things conspire when one tries to cheat fate.

Oliver North was found guilty in court. On appeal it seemed his testimony before Congress had expanded to too many areas that were under the immunity grant he demanded for his testimony. That some of the questioners on the congressional panel may have desired that outcome, and entered into areas they promised not to, made the prosecution's case more difficult. The testimony he gave did implicate his higher ups and they would have been worth sending to prison in North's place. Those men were pardoned by George Bush the first before they could answer for their crimes.

While leaving office Bush pardoned Caspar Weinberger, the former secretary of defense, Elliott Abrams, former assistant secretary of state, Robert McFarlane, a former national security adviser, and CIA members Clair George, Alan Fiers Jr. and Duane “Dewey” Clarridge.

Had those men gone to prison, the chances of our ever having gone to war in Iraq would have been remote, but you can't blame the judicial system for the failure, that was pure party politics.

Personally not a Patriots fan (my wife's family is however) ...

I do find it interesting that Brady and team is one win away from being in the Super Bowl again.

I really haven't thought much about it since the first four weeks. It would have been more interesting if he would have been suspended the last four games of the season. Games that matter. After all, it was the first game of the playoffs when he "cheated"

Heck, that's a brilliant idea! Let's make "suspensions" a category that the opposing coaches have some input into as they see how badly they can screw up a team and deny them the playoffs. I can imagine "Joey the Steamroller", who plays for the "Shameless Manipulators" doing something absolutely egregious in the first game of the season; say, biting an opposing tackle's nose off, and the league handing down a 2-game suspension. At that point, the coaches of the teams the Manipulators will face the rest of the season would all get together and make concessions to each other as they advance their own agendas for which games they want the Steamroller ineligible for. The tactical considerations are awesome. I can imagine a little horse-trading along the lines of I'll agree not to start my Hunk of a TE in the game I face you if you agree to make one of the suspension dates be when my team has to play the Manipulators on week 14...

I mean, obviously, the game's too much focused on players right now, correct? And just a FEW players, even worse. Owners! Assistant Coaches! Ball Boys! Traiuners! they're all a part of the machine, they should get a cut of the crime AND the punishment for the crime AND the spoils of victory as the league is manipulated behind closed doors in pricey bordellos!

Be careful what you wish for -- a few years ago I was ridiculed when I wrote in to a sports talk show that the way to stop injuries to quarterbacks was to "de-criminalize" intentional grounding ... if a team wanted to sacrifice a down that was their right. It was only a couple of years later that it was partially ruled legal.

Along the same lines, baseball suspensions are a joke, when the player can "appeal" and serve the sentence at their (and the team's) convenience (also, starters should get five times the normal term so they miss the same number of opportunities to play) -- maybe the managers of division opponents should determine when the offending player sits.

For the record, I am in no way a Brady hater. That said, I'm just glad we have 4 good teams this year in the playoffs, and more importantly... Four good quarterbacks to watch.

Yah! Brady, Aaron Rodgers, and Big Ben are all shoo-ins for the hall of fame. Matt Ryan is having a simply stupendous year. It's a great playoff season. I'm pulling for Pats versus Pack in the Super Bowl.

I made a "prediction" before the season that it would be Steelers/Packers. But If I could pick from the four remaining, I would want to see Patriot/Packers or Falcons/Steelers. I think those to match-ups present the best game. jmo.
