Someone added a "like" to my photography facebook profile. The part that made me wonder who the hell it was, was because of the cover picture. This is the cover picture.

Cover photo

Obviously pictures of Carla Facciolo. The picture of Carla with the guy in the middle is my photo with the copyright cropped off. Keep in mind that the woman's profile is not Carla Facciolo. So then I went to the website on the photo.

First Covers

Looks like people can steal photos and use them as facebook covers (which they already could anyways), but is the website allowed to use photos that have copyright statements on them and use them without the photogs permission?

Don't get me wrong, it's probably pointless pursuing anything...and even telling the person to remove the cover may be a waste of time...but I'm curious about the legality.

i would think if someone removed a copyright, that's a no-no to start.

I wouldn't bother with the person who has this as her profile picture. But, you could certainly ask First Covers to remove your shot from their collage of images. Is there a fair use thing with celebrities? It would seem they're not making any money off the shot (as in not selling it). I don't know.

eta: Maybe ask First Covers to add your copyright back in.

I visited the site briefly. It looks like they are adding their tag to the covers. While they are not selling the covers, I suspect that there will be income generation from advertising, etc. in the future.

Rights not defended are soon lost.

this is probably the simplest way to deal with it.

while i agree with ambaker, i really believe you have to make conscious decisions about what you post on the internet and where you post. if you just put it out there, assume it is going to show up somewhere else. even participating in a challenge here is no different that putting it on an open flickr account - it's out there and there's no real control over what happens.

or, you can put them in private galleries made accessible to only those you grant visitation rights.

if you're putting stuff out there to support your marketing, separate your stuff into two separate piles: a short stack of stuff that gets your point across and a big pile of everything else. the thing about the short stack is that it is also stuff you don't care about in terms of where it goes.

wow..i didn't see that link. I think that will be what I do. At least if my photo is going to be used, the copyright should still be there.

So I guess my work is starting to look good now...Just saw on facebook someone else steal my photo and put it on instagram with a filter on it and then tag the model. To me it appears as if he took the shot.

I posted a copyright notice as a comment on the photo and the guy messaged me and asked if he should take it off.
