I don't think it was used by Apple, but the app developers, who may need to get their weenies whacked.

I just did that, along with 10 other pages , this is stunningly weird. I have found some of my other surfing shots, published in newspapers, advertising agency's, a gaming website, 1 of them in a medium hard core website.

And it would appear that 1X is the place they are getting them from, 7 out of 10 have the 1x logo on them , which at least still has my name on them

I can't believe that you haven't received credit for your shots... and an ADVERTISING AGENCY!!! REALLY?

Thievery is everywhere. Good luck with getting them to pay. Your shots are amazing, it's not wonder the used stole them

If you want to smack them, you need to do a few things first.

You might be able to turn them into a customer if you go about it the right way. Of course, if they don't play along, you can switch to hardass mode.

If you just want to kick them in their dangly parts:

Send them a certified letter containing an invoice for the infringement. (Be generous to yourself, they've already agreed to pay you by using the image, now you get to tell them how much they spent.)

You need to send out a DMCA takedown notice. Here's the basics of how

Well, I was going to send them a letter, but even though they are in teh Apple store, all over Mac News and CNET, there is nothing in the way of contact info bar a drop box

I don't mind people that take the photos and use them when it is credited to me or back to me for non commercial use, but after my last client stole her photos and removed all watermarks and then proceed to Twitter and FB about how she took her own photos and edited them and then tell everyone she was going to use them for her upcoming CD and pro photos, and then proceed to never EVER pay me and then state on FB that I stole my own pictures and concept, forgered her signature on my Model Release and then go ahead and forge it onto a new contract and then proceed to write a long email as to explain why I am a c***.

I am a little upset, with my own policy lol

Which shows they're using an intermediary to protect themselves against spam. privacyprotect.org does have both a "Contact Domain Owner" and a "Report Abuse" forms on their page. You might start there. If you report abuse to privacy protect, they should provide you with proper contact information for the app developers.

the FIRST thing you want to do is REGISTER YOUR IMAGES WITH THE US COPYRIGHT OFFICE

seriously. you can get them to take it down, you can bill them, you can scream and holler, rant and rave, but if you want teeth and want to collect real money, you have registered your images. it's not a big deal, it really doesn't cost that much. all it takes is putting that process into your workflow. there are plenty of threads here on the topic and the US Copyright Office has a ton of resources online. you can't really expect others to respect your property rights if you aren't going to protect them yourself (and that means going all the way, not just putting on a watermark...)

bummer that it happened, hope you can make this work out for you.

Privacy Protect is in Australia, Creative Apps isn't necessarily based there :)

Be Sure also to grab Screen shots of the infringment, so when they take it down to cover it up you still have the evidence =)

If you look, their servers are Russian, hence the .ru

Well, got screen shots of everything I can find.

Also, if I have done it correctly sent off all my surfing shots to the copyright office via electronic thingy (I hope) YAY just looked in email and it worked
